On Tuesday, the Aerosmith frontman celebrated his 76th birthday, and the band paid him a sweet tribute on Instagram.
Along with a video of Tyler performing on stage in glamorous costumes for years — throwing a mic stand, climbing down a pole, jumping on stage — the legendary rock group shared the caption: “Let’s all wish a HAPPY BIRTHDAY to the one and only Demon of Screamin’, Mr. Steven Tyler! Sound off and wish Steven a happy birthday in the comments!”
Steven Tyler earns legal victory as court rejects plaintiff’s claims that publication of memoir caused emotional distress
Earlier this month, a Los Angeles court granted the “Dream On” singer’s request to dismiss parts of a sexual assault lawsuit filed against him in 2022 by a woman who claims she had sex with the Aerosmith rocker when she was a teenager in the 1970s. .
The court decided it would strike out the portions of Julia Misley’s lawsuit against Tyler that alleged she suffered “intentional infliction of emotional distress” (IIED) based on Tyler’s publication of his memoir.
After initially filing a lawsuit in December 2022 alleging sexual assault, sexual assault and IIED, the rocker responded by arguing that she could not use his memoir as a cause of emotional distress in court, as it was free speech and his writings were not. identify.

In court documents, Tyler said his memoirs were published in 1997 and 2011, and because Misley didn’t sue until 2022, her IIED claim was barred by the two-year statute of limitations.
He also argued that her claims were barred by the First Amendment because his memoirs “convey his own experiences from his life worthy of publication.”
Attorneys for Misley did not immediately respond to PEOPLE’s request for comment, and Tyler’s rep declined to comment.
Misley claimed she had sex with the star when she was a teenager, and that the “Dream On” singer convinced her mother to give him custody of her when she was 16 so they could continue their relationship.

Although she did not name Tyler in her lawsuit, her claims were consistent with comments he made in his 2011 memoir. Does the noise in my head bother you? about a relationship with a 16-year-old girl. However, Misley ended up naming Tyler in a follow-up statement.
Tyler’s memoirs don’t mention Misley’s name, although he says he “almost took a teenage bride” because “her parents fell in love with me, signed the paper to give me custody, so I wouldn’t get arrested if I took her out of state. I took her with me on tour.”
In April 2023, Tyler responded to his accuser’s lawsuit denying all the allegations against him and stating that she consented to their sexual relationship. He also claimed immunity as her legal guardian and asked for the lawsuit to be dismissed (her lawyer suggested that Tyler had “taken a shine to her”).
