In the present case, Agnivesh Agarwal filed an appeal against the order of CIT(A) (Commissioner of Income Tax (Appeals)) dated June 30, 2014, for the assessment year 2009-10. The bone of contention is the amount of additional income of Rs 2,40,000 levied by the Assessing Officer (AO). Agnivesh Agarwal’s appeal mainly revolves around two main points. First, he disagreed with the CIT(A)’s recognition of the AO’s revenue mark-up, arguing that it lacked proper reasoning and lacked a show-cause notice (a “show-cause notice” is a formal request for an explanation of the AO’s revenue mark-up). cause legal problems). Secondly, he argued that the CIT(A) did not adequately consider his explanation and did not give him an opportunity to respond. Agarwal explained that there was no clear basis for the increase in income of the Assessing Officer and the income of family members should be included in it to meet his expenses. The CIT(A) rejected Agarwal’s contention and sided with the Assessing Officer. However, upon review, the tribunal held that the increase in assessing officer was arbitrary and lacked proper justification. They also pointed out that the CIT(A) did not take adequate account of Agarwal’s explanation and the Assessing Officer’s amount of Rs 2,80,000 lacked clear justification. The court found Agarwal’s arguments regarding the use of family income to be reasonable and therefore ruled in Agarwal’s favour. The revenue markup was eliminated on August 31, 2017.
