The outcome of Ben Roberts-Smith’s defamation lawsuit against three Australian newspapers over claims that he committed war crimes in Afghanistan will be known by next Thursday. Roberts-Smith is Australia’s most decorated living soldier.
The verdict, which will be announced by Justice Anthony Besanko in Sydney on June 1 and follow one of the most dramatic and significant cases in Australian legal and military history, will mark the conclusion of a nearly five-year judicial procedure.
Three publications have accused Roberts-Smith, a former SAS corporal and Victoria Cross recipient, of killing six people between 2009 and 2012 while serving in Afghanistan, including pushing a shackled prisoner over a cliff before giving the order to shoot him.
Additionally, he is alleged to have ordered subordinates to execute captives, machine-gunned an unarmed crippled man to death, frequently bullied and attacked fellow soldiers, and used domestic violence against a woman with whom he had an affair.
Roberts-Smith vigorously refutes all of the accusations. He filed a lawsuit against the Age, Sydney Morning Herald, and Canberra Times, claiming that their reportage had falsely painted him as a killer and war criminal who had “broken the moral and legal rules of military engagement.”
The attorneys for Roberts-Smith testified in court that their client’s accusers were “fabulists and fantasists,” failed soldiers enraged by their own “cowardice,” and motivated by a “corrosive jealousy” of their comrades’ achievements.
Roberts-Smith stated in his testimony as the first witness before the federal court that the Victoria Cross he received in 2010 for extraordinary bravery was not an honour he desired but, ultimately, a responsibility “thrust upon him.”
“It put a target on my back,” he alleged in court. Up to $25 million in costs could be assessed against the losing party. Roberts-Smith stands to receive many millions more in damages if he prevails.
To fund the slander lawsuit, Roberts-Smith borrowed money from his boss, media tycoon Kerry Stokes; if he loses, he has pledged his Victoria Cross as security.
The verdict, though, might not be a simple yes-or-no choice. The judge can decide that some of the charges were successfully proven by the media on the balance of probabilities, which is the civil standard, but not others. If this is the case, the verdict will likely involve a balancing act between the allegations’ harm to Roberts-Smith’s character and those that were supported by evidence.
