When Danny Masterson was found guilty of rape in his Los Angeles retrial on Wednesday, his wife, Bijou Phillips, was present in the courtroom. Two counts of rape committed by Masterson against two women who had formerly belonged to the Church of Scientology, of which he is now a member, were found to be true.
Six weeks after the trials began, Phillips screamed as the verdict was announced in Los Angeles Superior Court on Wednesday. The actress was warned by Judge Charlaine F. Olmedo to maintain her composure or leave the courtroom.
Because of the “violent nature of the crimes” and his potential for eluding capture, Masterson was immediately remanded into jail. His subsequent court appearance is set for August 4. The jury was split on the third charge of rape, despite the troubled actor being found guilty on the first two charges. Masterson may spend up to 30 years behind bars. The jury, which was made up of five men and seven women, took just over a week to deliberate.
Olmedo declared a mistrial in November after the jury returned with a hung verdict. Prosecutors said that this time, Masterson, 47, drugged his alleged rape victims and acted like a “predator” who believed he could hide behind the Church of Scientology’s defence.
More than three years have passed since Masterson was required to appear in court on allegations that he sexually assaulted three women at his Hollywood Hills home between 2001 and 2003. The court declared at the time that she “found all three witnesses to be credible and the evidence sufficient to support the charges.”
Masterson was charged with raping a 23-year-old woman between January and December 2001; he entered a not guilty plea to three counts of forcible rape. Prosecutors claim that the actor was also charged with raping two women, aged 28 and 23, whom he allegedly invited to his house between October and December 2003.
On June 17, 2020, the actor was finally taken into custody and released three hours later after paying $3.3 million bail. Since then, he has been free on bail. The allegations of sexual assault initially came to light in 2017, after it was reported that Masterson was the focus of an LAPD investigation.
Leah Remini, a former member of the Church of Scientology and the inspiration behind the A&E docuseries Leah Remini: Scientology and the Aftermath, which sought to expose the church, contacted the women after they made their accusations, according to a lengthy statement later issued by Masterson.
