Princess Diana, Meghan Markle, and Johnny Depp were among David Sherborne’s former clients. He is now leading the legal team battling Associated Newspapers Limited (ANL), the company that publishes the Daily Mail and Mail on Sunday, in the High Court.

Along with Baroness Doreen Lawrence, Liz Hurley, Sadie Frost, Sir Elton John, David Furnish, and Sir Simon Hughes, Harry, the Duke of Sussex, is suing ANL for allegedly engaging in unlawful news gathering beginning in 1993.

A series of ledgers that were given to the Leveson Inquiry into press standards in 2012 and are allegedly proof of payments to private investigators are a major factor in the legal dispute.

The leaked notes’ source, Mr. Sherborne, who served as an attorney at the investigation and signed a confidentiality agreement covering the material, denied responsibility to the court on Tuesday morning. He informed the court that none of the three signatories who are currently a part of the claimant’s group were the means by which the documents in this case reached the claimants’ solicitors.

ANL claims that the Leveson Inquiry regulations, which can only be changed by a government minister, ensured the evidence’s confidentiality and should therefore be excluded from the privacy dispute.

However, Mr. Sherborne contended that the investigators are not under “super-added duty” to monitor any usage of the same material they observe by unrelated third parties. He claimed that if the information had become public through another means, it could still be used legally in civil proceedings.

Hurley, Sir Elton, and Furnish are all “close friends of Hugh Grant, who was a core participant in the Leveson Inquiry,” according to ANL’s written submissions to the court. Additionally, Baroness Lawrence is “associated” with DCI Clive Driscoll, another Leveson Inquiry witness.

On Monday, the publisher was said to have written a news release that expressly linked Mr. Sherborne to his participation in the Inquiry. ANL asserts that the evidence was “protected by orders made by Lord Justice Leveson” and that it is now too late to pursue the legal claim.

According to the report, there is a “wealth of information” about previous practises at the Mail newspapers that is in the public domain, and Mr. Sherborne himself testified to the Inquiry more than ten years ago that buying private information is “widespread throughout Fleet Street” and that ANL is a “particular offender [which was] top of the table.”

ANL contends that the claims might have legitimately been brought within the customary six-year window. Prince Harry is seated two rows behind Mr. Sherborne as he spends the majority of the second day of the proceedings on his feet arguing legal arguments.

A recent victory for Coleen Rooney’s legal team in the Wagatha Christie High Court trial was achieved by the Oxford-educated lawyer, who went to the same school as longtime Daily Mail editor Paul Dacre.

Among his impressive list of former clients are Harry Styles, Kate Moss, David Beckham, Tony Blair, and Sir Paul McCartney. Mr. Justice Nicklin stated during his testimony before the court that he is “concerned” about who is in charge of upholding confidentiality agreements signed during the Leveson Inquiry.

According to him, “basic contract law” dictates that someone must be able to use their authority to enforce a confidentiality agreement in order for it to be carried out.

I am now concerned about who is in charge of policing the Leveson undertakings, he said, adding, “Who is that person?” He suggested that the judicial processes might be suspended until authorization from the government to utilise such papers as evidence is sought.
