Elis Nelson Ortiz-Nieves filed an appeal after being found guilty of first-degree child abuse and felony murder. He claimed that his attorney was incompetent and that some of the trial testimony “was based on junk science.”

Giovanni Mejias was beaten to death on June 13, 2017, and Kent County Circuit Court Judge Mark Trusock referred to it as “sickening and disgusting” during sentencing.

Deputies from Kent County were called to a house trailer in Gaines Township where Ortiz-Nieves had been left in charge of multiple kids under the age of 11, including Mejias. The boy’s mother and Ortiz-Nieves were dating at the time.

A Kent County assistant prosecutor said during the trial that deputies discovered Mejias “actively dying on the kitchen floor.” He died from internal bleeding brought on by an abdominal rip, according to an autopsy. The injury was one that an adult, not a youngster, would have been able to create, according to the investigators.

According to the autopsy, Mejias died from internal bleeding brought on by a roughly two-inch tear in the mesentery, which connects the stomach, small intestine, and other organs to the posterior wall of the abdomen.

Mejias also sustained wounds to the top of his head, his lower back, and his buttocks, in addition to two fractured ribs that were still healing.
