According to Small Claims Court Judge Yves Hamel, the plaintiff has sustained considerable psychological harm to date. Therefore, Judge Hamel concurs with Michelle Charron, who testified that Guy Cloutier assaulted her in a Montreal hotel room in 1977 while she was trying to break into the Quebec entertainment industry.

In September 2020, Ms. Charron, 65, submitted an appeal to the Court of Quebec’s minor claims division. She was requesting $15,000 for lost pay, emotional distress, and the end of her career.

“She claims that after speaking with him on the phone, she later ran into him in Montreal. The 83-year-old Guy Cloutier skipped the trial. He only sent an affidavit in support of himself. It “is not sufficient to set aside or significantly weaken the detailed and consistent version offered by the plaintiff,” Judge Hamel found.

Because the court must “be able to assess [the defendant’s] seriousness, sincerity, accuracy and veracity,” according to the magistrate, “the Court grants little or no probative value to the defendant’s written evidence.”
