Harish Salve is an Indian lawyer and Senior Advocate of the Supreme Court of India. He is known for his expertise in constitutional, commercial and tax law. In 2017, he appeared for India in the Kalbhushan Jadhav case before the International Court of Justice (ICJ).

Profession
Harish Salve started his legal career in 1980 as a trainee at JB Dadachanji & Co in Delhi. He later began working as a full-time attorney at the firm. While working there, he assisted prominent Indian lawyer Nani Palkhivala in the Minerva Mills case. Later, the Delhi High Court appointed him as Senior Advocate. Harish Salve worked with former Attorney General Soli Sorabjee from 1980 to 1986.

On November 1, 1999, he was appointed Solicitor General of India until November 3, 2002. After his initial three-year term ended in 2002, the Indian government proposed his nomination for a second three-year term. He declined a one-year term citing “personal reasons.” As a legal representative of the Union of India, Harish Salve has handled many important cases such as the first anti-dumping case before the Supreme Court and the first privatization case involving a public utility unit (BALCO case).

The Supreme Court has appointed Salve as amicus curiae in several cases, mostly to deal with environmental protection issues. However, he withdrew from the role during a hearing on illegal mining in 2011 because he had previously represented one or more interested parties. In 2013, Salve became a member of the Law Society and subsequently joined Blackstone Chambers. Harish Salve was appointed Queen’s Counsel to the Courts of England and Wales on 16 January 2020.
Famous cases
Vodafone case
In 2012, Harish Salve represented Vodafone in a $2.5 billion tax dispute with the Indian government. Initially, he lost the case in the Bombay High Court. However, he later won the case in the Supreme Court. He was temporarily transferred to London and moved his office there to focus on the case. He strongly criticized the Indian government for making retroactive changes to the Income Tax Act in the 2012 Union Budget, nullifying the Supreme Court ruling.
Bilkis Bano case
In 2003, Harish Salve represented Bilkis Bano, a survivor of the Gujarat riots, under the guidance of the National Human Rights Commission. Salvi asked the Central Bureau of Investigation (CBI) to launch a fresh probe into the case. Later, he demanded that the trial be held in Mumbai instead of Gujarat. This is the only case in the Gujarat riots to be re-investigated by the CBI.
Salman Khan case
In 2015, he represented Bollywood actor Salman Khan in a 2002 hit-and-run accident case. Previously, Salman Khan was sentenced to five years in prison for a car accident that killed one person and injured four others. During the trial, another Mumbai-based lawyer named Amit Desai took over the case for a short period. However, the Bombay High Court later stayed the lower court ruling. On December 10, 2015, Salman Khan was cleared of all charges related to the 2002 car accident and drunk driving.
Kubushan Jadhav case
In May 2017, he represented India in the Kulbhushan Jadhav case at the International Court of Justice. Jadhav was sentenced to death by a Pakistani military court on charges of espionage. Following Salvi’s strong arguments, the ICJ temporarily stayed Jadhav’s execution until a final decision was made. Furthermore, Salve received legal fees of only Rs 1 for its services in the case.

Other cases
Harish Salve has represented several large companies, including Mukesh Ambani’s Reliance Industries Limited, Tata Group and ITC. He has also appeared for Mukesh Ambani in the Krishna Godavari Basin gas dispute case. He also personally represented Ratan Tata in various legal matters. In 2011, he provided legal defense to Keshub Mahindra in the Bhopal gas tragedy and represented the Delhi Police in the midnight crackdown on supporters of Baba Ramdev. He also served as defense counsel in the Aarushi-Hemraj double murder case.

In 2009, a civil rights group called Citizens for Justice and Peace (CJP) questioned Harish Salvi’s suitability to serve as amicus curiae in the Gujarat riots case. Kamini Jaiswal, a representative of Citizens for Justice and Peace (CJP), accused Salve of not conducting a proper investigation into the complaints filed by the CJP. Retired Supreme Court judge PB Sawant also expressed concern over Salve’s appointment as amicus curiae in the Gujarat riots case due to the allegations.

In 2011, Harish Salve was accused of supporting Eros Energy in setting up a 25 MW power plant in Gujarat. The allegation came to light when Tehelka magazine revealed in an article email correspondence involving Eros Energy’s Kishore Lulla, Harish Salve and senior officials of the Gujarat government. In an interview with Ashish Khetan, Salve admitted that the facts mentioned in the article were true. However, he denied any chance of quid pro quo as amicus curiae. Speaking about it in an interview, he said,
I came out against the wrongdoings of Narendra Modi and his government. I will not be there against Gujarat. If a project is good for Gujarat, I will again direct it to Gujarat. If you can prove that I received a single rupee from this, I will leave this profession and leave. “
