New details are emerging about Jay Cutler’s DUI arrest Thursday night in Franklin, Tenn.
Cutler, 41, allegedly rear-ended another vehicle in downtown Franklin on Thursday, Oct. 17, and attempted to flee the scene before offering to pay the driver of the vehicle $2,000 if he did not call police, according to charging documents obtained by him PEOPLE.
The retired NFL quarterback and reality TV star was arrested after police responding to the scene noticed he had “bloodshot eyes” and smelled of alcohol, according to a statement police shared with PEOPLE on Friday morning.
The arresting officer wrote in an affidavit that police then searched Cutler’s vehicle and discovered the rifle, as well as a loaded handgun, according to a Williamson County, Tennessee, document.
A spokesperson for the Franklin Police Department told PEOPLE Friday morning that Cutler was charged with DUI, unlawful possession of a weapon while intoxicated, implied consent and failure to exercise due care to avoid a collision. Cutler was released Thursday night on $5,000 bail, a spokesman said.

The arresting officer says he “observed Mr. Cutler staggering, swaying and walking with heavy legs” at the scene of the crash, according to the affidavit.
“I also noticed that he was speaking in a slurred, slurred manner and was mumbling,” the officer reports in the document, adding, “Mr. Cutler’s eyes were bloodshot, glassy, red/pink, watery and dilated.”
The officer noted that Cutler had an “overwhelming odor of an alcoholic beverage” and initially denied that he had been drinking prior to the crash. “I then informed Mr. Cutler that I was an advanced enforcement officer with road damage and I knew he was lying to me,” the officer wrote in the affidavit. “I then asked him again how much alcohol he had had and Mr Cutler said he had had a little.”
Cutler then refused a field sobriety test, according to the officer, who then took him into custody and later served a blood search warrant. Former Very Cavallari star had his blood drawn for alcohol testing at Williamson Medical Center, according to the affidavit.
After Cutler was taken into custody, the arresting officer says a patrol officer searched Cutler’s truck and “a rifle was found in the back seat, as well as a loaded Glock pistol in the center console.”

Cutler “denies that he was involved in the crash, but there is a small dent in the rear of the other vehicle,” the officer wrote in the affidavit, noting that Cutler’s truck “had a winch on the front” that prevented police from seeing any damage from the alleged crash.
PEOPLE has reached out to Cutler’s representatives for comment.
Cutler played 12 seasons in the NFL for the Chicago Bears, Miami Dolphins and Denver Broncos. He married former Laguna Beach star Kristin Cavallari in 2013, and the couple later became the focus of E! Very Cavallari program from 2018 to 2020.

Cavallari and Cutler, who have three children – sons Camden, 11, Jaxon, 9, and daughter Saylor, 8 – filed for divorce in 2020, citing “irreconcilable differences” and “marital misconduct” as reasons for their separation. interruption.

In his divorce petition, Cavallari claimed that Cutler was “guilty of such unbecoming marital conduct as to render their continued life together unsafe and inappropriate” and said that “any misconduct alleged or implied against her” in Cutler’s divorce petition “either in response to and/or as a result of misconduct on [Cutler’s] on behalf of.”
Cutler is scheduled to appear in court on the DUI and gun possession charges on January 16, 2025.
