Jordan Peterson, the controversial psychologist, has lost a legal battle in Ontario, with a court upholding a regulator’s decision to require him to undergo social media training or risk losing his license to work.
Three judges of the Ontario Divisional Court on Wednesday issued a majority decision in a case involving Peterson’s divisive language and online posts, siding with the Ontario College of Psychologists.
The college’s requirement that Peterson enroll in a course on professionalism in public speaking, according to Judge Paul Schabas, was consistent with the college’s duty to govern the industry and “does not discipline or prevent Dr. Peterson from expressing himself on controversial topics.”
The court rejected Peterson’s claim that he made his remarks in his “off-duty opinions” and not as a professional psychologist.
According to Schabas, “Dr. Peterson considers himself a professional psychologist “in the broad public domain” where he claims to help “millions of individuals.”
Peterson cannot speak in his trusted capacity as a member of a regulated profession without accepting responsibility for the risk of harm resulting from doing so.
Peterson, a retired psychology professor at the University of Toronto, became known for his divisive YouTube videos criticizing liberal culture and his best-selling self-help book, “12 Rules for Life: An Antidote to Chaos.”
Peterson stopped seeing patients in 2017, but since at least 2018, the organization that oversees psychologists in Ontario, of which he has been a registered member since 1999, has received complaints about Peterson’s online comments on topics ranging from gender reassignment to climate change.
A Sports Illustrated model, a transgender actor named Elliot Page and posts targeting Canadian politicians were among the specific complaints detailed in the case before the Divisional Court.
When Peterson appeared on the podcast “The Joe Rogan Experience” last November, the college’s grievance committee found that he “may have made degrading, demeaning and unprofessional comments” and claimed to be a clinical psychologist. He also seemed to be disparaging a former client. According to the college’s code of ethics, members must speak respectfully and refrain from “unfair discrimination.”
The grievance committee concluded that Peterson’s remarks carried a “moderate risk of harm to the public,” including “undermining public confidence in the psychological profession” and the college’s ability to police the industry. A social media tutoring program was subsequently approved, at Peterson’s expense, with the clear warning that refusal to comply could lead to charges of professional misconduct.
Peterson sought judicial review, arguing that the institution should not have the authority to regulate his political criticism and that the college failed to properly balance its mission with his right to free expression.
Free speech advocates and regulators in other areas have been watching the case closely. The Canadian Civil Liberties Union, the College of Physicians and Surgeons of Ontario and the LGBTQ+ rights organization Egale Canada were among the interveners.
By seeking ancillary counsel, the college, according to Schabas, chose a legitimate course of action that preserved his professional standards but did not affect Peterson’s constitutional right to free expression.
