Donald Trump, the former president, was furious when he learned that Judge Juan Merchan would be conducting his criminal investigation in New York.
On Friday morning on Truth Social, Trump said: “The judge ‘assigned’ my witch-hunt case, a ‘case’ that was NEVER UPLOADED, HE HATES ME. Trump said Merchan “forced” Allen Weisselberg, his former chief financial officer, into taking a plea deal.
However, Merchan has a well-known reputation as a cold-blooded man and is far from the type of judge who intimidates the people who appear before his court. He is quite a calm man. He’s considerated. He listens. Adam S. Kaufmann, a New York attorney who worked with him in the Manhattan District Attorney’s Office in the 1990s, described him as “bright, somewhat quiet.”
Merchan’s demeanor in court is firm. It often stops. To avoid appearing biased, carefully consider how to formulate a proposal or inquiry. His speech has an adagio pace, which is relaxing and a bit slower than the pace of a normal Manhattan criminal judge.
Merchan often lost his cool while presiding over the tax fraud trial of two Trump Organization companies in December because Trump’s corporate lawyers broke the law by subpoenaing witnesses, reading parts of the transcripts that jurors couldn’t hear, and trying to dissuade the jury from believing it was Trump as a person, not about his companies.
He repeatedly dragged lawyers for Trump Corp. and Trump Payroll Corp. into a quiet side room during the trial to privately berate them for making unwarranted comments to end the prosecution, only to be ignored minutes later, leading to the judge to order the jury out of the courtroom. He angrily told them, “It’s your job to make sure…this doesn’t happen again.” He eventually ordered the convicted companies to pay $1.6 million in back taxes and gave Weisselberg, who had already pleaded guilty, five months to serve time on Rikers Island.
