Kroy Biermann is seeking full control over the sale of the Georgia mansion he shares with ex Kim Zolciak.
The former NFL player, 38, claims Zolciak, 46, is rejecting offers on their $3.95 million home despite the property facing foreclosure in October 2024, according to legal documents obtained by PEOPLE and first reported by TMZ .
In documents filed on August 30, Biermann claims that The Real Housewives of Atlanta Alum’s “frivolous spending” left them with only one advantage, a shared marital home. The property had been nearly foreclosed on “at least twice” before that, according to the documents.
Biermann states that Zolciak “claims she has no money,” but she “buys $400 bottles of wine per case” and “continued to buy clothes, get plastic surgery, gamble online and go out almost every night.”

The documents claim that Zolciak’s “complete disregard” for the former couple’s “financial situation” will have devastating consequences for them and their children.
They share Kroy “KJ” Jagger Jr., 13, Kash, 12, and twins Kaia Rose and Kane Reno, 10. Zolciak also has two older daughters from a previous relationship, Brielle, 27, and Ariana, 22, whom Biermann legally adopted.
Biermann is asking the court to “compulsorily sell the house” at a price it deems acceptable and “remove [Zolciak] from any decision-making process.”

Biermann also claims that Zolciak said “she didn’t care if the house went into foreclosure.” She reportedly does not want to accept an offer of less than $3.85 million for the property because then she “wouldn’t have enough money to buy her own home.”
However, Biermann’s line of credit is the one that will be affected because his name is on the mortgage and the contract, while Zolciak’s name is only on the contract, according to the filing.
According to the documents, “there is a $1.32 million lien on the home from the IRS” and their mortgage lender “owes approximately $2.2 million.” They also owe $250,000 on another lien in addition to three attorneys’ liens.

Zolciak has since responded to Biermann, telling TMZ on Monday (September 9) that she pays “all the bills” in their home. She called his latest lawsuit a “game” and alleged that he said he would publicly destroy me if she ever divorced him. She also claimed that he is trying to reconcile, but she is not interested in that.
She said she was willing to sell the house, but asked, “Who would accept an offer of $3.5 million with an appraisal of $5.5 million?”
Zolciak and Biermann first put the home on the market for $6 million in October 2023, nearly two months after Biermann filed for divorce from Zolciak for the second time in August 2023. They’ve reduced the price several times since then. They first lowered the asking price to $5.5 million in December 2023, then to $4.5 million in January 2024, and again to $4.2 million in June 2024.
The mansion they bought in 2012 has seven bedrooms, a six-car garage, billiards and arcade rooms, a gym with a private massage room, a 500-bottle wine cellar, a heated pool and a home theater. , according to the listing on Zillow. The property covers 1.78 hectares of land.

In August, a source familiar with the property told PEOPLE that the house is worth much more than its current asking price of $3.95 million.
“It’s an amazing deal for a house of that size in such a nice neighborhood,” the source said after noting the house is listed at $5.5 million. “I can’t imagine it will be on the market that long.”
