Mary Roy v. Gender Biased Inheritance Law

The ruling ensures equal rights for Syrian Christian women in their ancestral lands as their male brothers and sisters.

Until then, the Syrian Christian community followed the Travancore Succession Act of 1916 and the Cochin Succession Act of 1921, while elsewhere in India, the Syrian Christian community followed the Indian Succession Act of 1925.

Mary sued George Isaac (Mary’s brother) and refused to share her inherited property due to the Travancore Succession Act 1916. Mary sued her brothers to get equal rights to the inheritance left to them, after her father’s death and that was the case that built her way through the Indian court system, which she won.

First, the lower court rejected her confession, then Mary remanded the Kerala High Court in 1994 to overturn the lower court’s verdict and succeeded. This case lasted for the next 8 years, after which Roy filed for foreclosure in 2009, and then she finally got the property.
