Mia Goth Sued for Alleged Battery and Wrongful Termination by Extra on MaXXXine

Mia Goth is facing legal trouble stemming from her film project MaXXXine.

A background actor in the film filed a lawsuit against Goth, 30, accusing him Infinity pool actress for abusing him and unfairly dropping him from the film after he filed a complaint against her. He also named the film’s writer-director Ti West and film studio A24 as defendants in the lawsuit.

In the lawsuit obtained by PEOPLE, a background actor named James Hunter claimed he was hired for three days in April to play “The Dead Parishioner” in the A24 horror film, which is about a girl who survived a massacre. He claims he was ordered to lie in the dirt on set for “several hours” and endured “ants and mosquitoes” while Goth ran past him on the ground for the scene.

Hunter claims that in the fourth take, Goth nearly stepped on him, and he notified another assistant director of the film who “warned” the actress to “watch her step,” according to the filing. He then stated that Goth “deliberately kicked” her head during the next shot.

After she kicked him, he said he felt a “headache” and a “stiffness in his neck,” which he reported to another assistant director, who notified Goth and West. He also noted that he was not offered any medical attention on set, and West continued filming until they completed the scene.

Hunter said his symptoms progressed and he experienced “vertigo” and “almost passed out twice,” adding, according to the filing, that both times he had to stop while driving home from the movie set.

The background actor also alleged that Goth “invaded” his privacy in the bathroom on set and “laughed at,” “taunted,” “taunted,” “belittled” him and even “challenged” him to “do anything about that”.

The following day, Hunter claimed that the casting agency notified him via email that he was “removed” for the “remaining two days of production” and “banned” from the film set for “no reason whatsoever”.

Over the next 48 hours, he said he continued to experience “head trauma symptoms” such as “memory loss, confusion and disorientation,” and eventually went to the hospital where he was diagnosed with a “concussion.” He also stated that he had “bruises and red marks” on his head after the impact.

“As a result of being kicked in the head by Defendant Goth, Plaintiff suffered, and continues to suffer, symptoms of head trauma, including disorientation, dizziness, migraines, nightmares, and severe emotional upheaval,” the lawsuit alleges.

Representatives for Goth did not immediately respond to PEOPLE’s request for comment.

Hunter said in the lawsuit that he is seeking $250,000 for “medical expenses,” “rehabilitation” and “related expenses,” along with “punitive and/or exemplary damages.”
