In the most recent legal victory for activists, a judge in Angeles City, Pampanga, cleared former CPP chairman and NPA commander Rodolfo Salas of the charge of illegally possessing firearms by finding that the warrantless search of his home was unlawful.
“The conduct of the search clearly violates the accused’s constitutional protection against arbitrary search and seizure. Because they are the “fruit of the poisonous tree,” according to the exclusionary rule in Article III Section 3(2), the firearm and ammunition seized from the accused are inadmissible as evidence in court, stated Angeles City Regional Trial Court (RTC) Branch 58 Judge Ramon Corazon Blanco in a decision dated July 1 but served to Salas only on Friday, August.
Salas was detained on February 18, 2020, according to a Manila Regional Trial Court (RTC) arrest warrant dated 2019, which was issued in connection with a murder case alleging a mass grave in Leyte containing victims of the alleged purge of communists. The Duterte administration’s continued campaign against the Left resulted in the issuance of warrants against Salas, CPP founder Jose Maria “Joma” Sison, senior adviser Luis Jalandoni of the National Democratic Front (NDF), and others.
Salas, who according to his attorneys was “long retired from the CPP” and was “rebuilding his life with his family in Angeles City,” was accused of illegal possession after police allegedly discovered a gun and ammo inside his home.
The murder case was not bailable, but the illegal possession of firearms case was. However, following oral arguments in the Supreme Court in March 2020, the justices decided to grant Salas bail in the murder case. Since then, he has been free. The murder investigation in Manila is ongoing.
The Free Legal Assistance Group (FLAG), Salas’ attorneys, prevailed in the illegal possession case on a demurrer. Salas did not need to provide evidence if the demurrer was accepted because, as the judge noted, “the prosecution’s case has no leg to stand on.”
The three arresting agents stated that they noticed a weapon and ammunition on the computer table in plain view when Salas took his glasses off the same table since they did not have a search order.
In principle, the plain view theory permits law enforcement officials to confiscate goods that they may see in plain view and that they believe may constitute proof of a crime.
But throughout the trial, the police kept contradicting one another and themselves about where they discovered the weapon and ammunition: first on the computer table, then in the table’s drawer, then on the filing cabinet nearby.
The barangay officer, who was obliged to be present when the warrant was executed, claimed that he remained by the door of Salas’ home for 30 minutes. The police claimed that the barangay official was present inside the living room at all times, however that assertion was refuted by that statement.
