Profession

In 1992, she became an IAS officer in Madhya Pradesh. In February 2009, she was appointed as the Executive Director of the Synthetic and Rayon Textiles Export Promotion Council (SRTEPC). A few months after joining the post, she found some irregularities in the functioning of the department. She demanded a commission of inquiry to look into the entire incident. Her appeal was not addressed and she was ordered to return to her original post in May 2010. In an interview, her husband Nitish said:

The order came while she was on an official visit to Brazil and Argentina. The SRTEPC board wrote to the Ministry of Textiles (MoT) and the Department of Personnel Training (DoPT) stating that Smita’s services were not required. The ministry sent her back to Madhya Pradesh without asking any questions. We were really surprised to hear the news. Smita was posted as a deputation in SRTEPC. There was no provision in the rules for her to join a private company on her own.

Smita filed an RTI application in her counterclaim, seeking details of her transfer. When her case was referred to CAT, the bench of Justices Jog Singh and Sudhakar Mishra, who presided over the case, found that she was a representative and she had not joined SRTEPC voluntarily. Smita’s lawyer said,

The arguments and misrepresentations given by the Ministry of Transport in this case are appalling. It is impossible for an IAS officer to join a private company on his own discretion based on a NoC alone.”
