In the early hours of May 30, 2021, the 57-year-old DCI Banks actor is accused of hitting a man who was intoxicatedly making “strange noises” to the ground outside his residence.

Tompkinson testified in court on Tuesday that Karl Poole did not punch him and that he was “not responsible” for the double skull fracture that resulted from Poole’s head striking the concrete.

Tompkinson allegedly confronted Mr. Poole and his companion Andrew Hall, who were both “heavily intoxicated” as he emerged from his home at around 5.30 in the morning wearing only his pyjamas and a dressing robe.

In addition to being concerned about glass breaking in a place where his partner’s child plays, Tompkinson described seeing the men as a “horrible sight” when he first saw them.

The Ballykissangel singer testified in his defence, claiming that he reached out to stop Mr. Poole from approaching him and made contact with his face, but that it “wasn’t enough to knock him down.”

Tompkinson responded, “Absolutely not,” when asked by his lawyer Nicholas Lumley if he had anything to gain from hitting Mr. Poole. Everyone in the public has the potential to be a part of your audience, so you must always treat them with respect.

To do something so outrageous as assaulting someone would be career suicide. Since being charged with grievous bodily injury, Tompkinson said that his acting profession had been “taken away” and that “any association with me is put on hold” while the judicial process is ongoing.

“I’m not trying to compare my situation with the injury Karl suffered,” he said in court, “because they don’t compare.”

Jurors learned that Mr. Poole had traumatic brain damage as a result of the incident on the first day of the trial. Tompkinson claimed that he, his partner, and her kid, who was seven years old, were residing at Whitley Bay, North Tyneside, at the time of the alleged assault.

Jurors were told that when he awoke early that morning, he heard “strange noises,” observed two “heavily intoxicated” guys drinking at the end of his driveway, and experienced other “weird noises.”

With a bottle of Jagermeister in hand, Tompkinson claimed to have seen the two repeatedly trip and fall, saying, “It seemed to me they were the very definition of drunk and disorderly.”

“Come on lads, look at the state of you, look at the time, there are people asleep in the house, you can’t be doing this,” he allegedly yelled to the men as he dialled 999 and waited to be connected to the police.

When asked if he was angry, Tompkinson responded, “I think there was a bit of angriness in there, it was a horrible sight and I certainly didn’t want the rest of the household to be greeted by them when they woke up.”

Tompkinson claimed that when he told the men he had contacted the police, the situation turned “frightening,” and the men stood up and began to approach him.

He claimed to have put his hands on Mr. Hall and “guided” him to the ground before spotting Mr. Poole approaching. I didn’t want to hurt him, but I did want to stop him from approaching me and moving more onto my land.
