Tom Sandoval is responding to a lawsuit from his ex-girlfriend, Ariana Madix, who asked them to sell the LA home they still share.
In court documents filed Friday and obtained by PEOPLE, Sandoval, 40, says Madix “does not allege sufficient facts to state a cause of action” against him and therefore believes the division of their shared home should not be granted.
According to the filing, Sandoval also claims that Madix, 38, “failed to mitigate the harm” he claims she suffered and did not act “reasonably and in good faith” when she filed the lawsuit against him.
If the home is approved to be subdivided, Sandoval claims he should “receive an accounting and compensatory adjustments” for repairs and improvements he made to the home, including changes “that increase value,” according to the document.

Ultimately, Sandoval disagrees with Madix’s request for a “split sale” that would result in an even split of the proceeds between her and Sandoval, as stated in her January lawsuit.
According to the documents, the reality star was hoping to avoid a “partition in kind” that could result in both retaining ownership of the property as one party could potentially sell their share to a third party.

The Vanderpump Rules costars purchased a newly completed 4,334-square-foot home in the Valley Village neighborhood in 2019 for $2.075 million, according to property records obtained by PEOPLE.
“We were looking at uppers for attachment, but we were also looking at [turnkey] places and considering the time we moved and how busy we are [we are] . . . I’m so glad we made the choices we made and didn’t have to do anything but fun things,” Madix told PEOPLE in 2021 about their house-hunting experience.
“We would have fucked each other, honestly. I’m delighted with how we chose things and everything really turned out for the best,” she added.

After nine years together, they officially broke up in March 2023 when Madix found out Sandoval was cheating on her with Leviss.
After their split, Sandoval’s rep revealed to PEOPLE that the exes are still living together in the house and that the situation is complicated.
“They own the house together, and what happens next with the property will take time to work out,” the rep said. “This is not something that will be decided on a weekend.”
