For initial and renewal EADs for certain non-citizens who must apply for employment authorization, US Citizenship and Immigration Services (USCIS) has announced that the maximum duration of EAD validity will be extended to 5 years. Many Indians now living in the US will benefit from the recent US announcement that it will grant employment authorization cards to certain categories of non-immigrants for five years, including those applying for green cards. For initial and renewal EADs for certain non-citizens who must apply for employment authorization, US Citizenship and Immigration Services (USCIS) has announced that the maximum duration of EAD validity will be extended to 5 years.

According to the federal government, these include applications for asylum or withholding of removal, adjustments of status under INA 245, and applications for suspension or cancellation of deportation. He said that by extending the maximum EAD validity period to five years, he will receive significantly fewer new Forms I-765, Application for Employment Authorization, for EAD renewals over the coming years, which will help in his efforts to reduce processing times and backlogs .

However, it added, a noncitizen’s underlying status, circumstances, and EAD filing category still determine whether they retain employment authorization. For example, if a person received an EAD under this category based on an application for adjustment of status pending for a maximum validity period of five years, and the application for adjustment is subsequently denied, their supplemental employment authorization could be terminated prior to the expiration date listed on their EAD, the document states. More than 10.5 lakh Indians are waiting in line for an employment-based green card, and 4 lakh of them may die before they get the much-coveted legal document that would grant them permanent residency in the US.
