Wendy Moore, 45, is set to be released in just under five years, but she hopes a petition she filed with the US District Court in March will allow her to be released from federal prison much sooner.

After his traditional appeals were unsuccessful, Moore once attempted a vote on the sentence. However, the judge gave her permission to present a new defense that her prison sentence should be overturned because the law under which she was sentenced may not be constitutional. By May 9, prosecutors must file a response.

In 2014, Moore and her ex-boyfriend Chris Latham, a former banker, were found guilty of participating in a failed murder plot against Nancy Cannon, a real estate agent and employee of the state lottery. Latham received a 10-year sentence for one charge, while Moore is currently serving a 15-year sentence for four charges.

When Latham and Moore, a secretary in his office, began dating, Moore was an executive at Bank of America in Charleston. Authorities say they planned to kill his wife during her difficult divorce. When a Charleston police officer stopped Aaron Wilkinson, a Kentucky man trying to get heroin on the city’s east side, in April 2013, the scheme backfired.

Wilkinson unraveled the murder plan, leading detectives to a “hit package” containing key information on Cannon when police discovered a gun in his car. Through a relationship with Moore’s ex-husband Samuel Yenawine, who later committed suicide while awaiting trial, Wilkinson became drawn into the scheme.

Wilkinson testified against Latham and Moore, becoming the government’s star witness and reducing his potential prison sentence. The Charleston Affair, a segment on Dateline, relied on the rapid national attention to the case.

Moore is expected to be released in January 2026 from a federal prison in Tallahassee, Florida. Latham is being held in Wildwood, Florida, nearly three hours away. The Federal Bureau of Prisons has determined that he is eligible for his release next February.

Moore previously used a variety of defenses to have her conviction and prison sentence overturned, including allegations of incompetent legal representation and allegations that Latham used her as a pawn in his illegal schemes. Latham also disputed her conviction, claiming the sociopath made up the story and took it “straight from a movie script.” All these justifications fell into the water.

This time, Moore is relying on an intricate legal defense based on a 2019 US Supreme Court ruling in a Texas robbery case involving a series of cigarette robberies. The same federal conspiracy statute that helped land Moore and Latham in prison also led to the convictions of the robbers.

Applicable legislation allows for more severe criminal penalties for using, carrying, or possessing a firearm in connection with any federal “crime of violence or drug trafficking offense.” However, the Supreme Court found that the statutory definition of violent crimes was unconstitutionally ambiguous and offered “no reliable way of determining which crimes qualify as crimes of violence.” The court concluded that the law was therefore invalid.
