On November 30, 2004, a foreign exchange student attending the University of New Mexico suffered a brutal attack, including rape, before he was able to escape. The brave victim positively identified Joel Patrick Courtney as her attacker. On September 12, 2007, Courtney pleaded guilty to the heinous crime. As part of the plea agreement, Courtney faced the possibility of a prison sentence ranging from 18 years to life, with an additional 5 to 20 years of probation.
Subsequently, police established a connection between Courtney, originally from Beaverton, Oregon, and the disappearance of Brooke Wilberger. In August 2005, Courtney faced a total of 19 charges, including aggravated murder, kidnapping, sexual assault, rape and sodomy.
