Following a lengthy investigation, the Independent Commission Against Corruption (ICAC) found former NSW Premier Gladys Berejiklian engaged in “serious misconduct” during her time in office. The ICAC report found that Berejiklian, along with former Wagga Wagga member Daryl Maguire, with whom she was in an undisclosed relationship, abused their positions for personal gain.

Although the ICAC has sought advice on whether to initiate criminal proceedings against Maguire, it will not recommend charges against Berejiklian. However, the corruption revelations have raised concerns about her executive position at Optus, where she was appointed managing director of enterprise, business and institutions after she resigned as prime minister in 2021.

Optus CEO Kelly Bayer Rosmarin had previously expressed her support for Berejiklian, but said she would reassess the situation based on the ICAC report. The company did not expect any information that would jeopardize her role. However, former political powerhouse Graham Richardson believes Berejiklian should resign from her executive job, suggesting Optus may not keep her.

An ICAC investigation revealed that Maguire improperly used his office and resources for the benefit of G8way International Pty Ltd. He failed to disclose his interest in the company and abused his position as chairman of the NSW Asia Pacific Friendship Group.

Meanwhile, Berejiklian breached the public trust by carrying out her official duties in connection with government-funded construction projects without disclosing her conflict of interest with Maguire.

Despite ICAC’s findings, Berejiklian’s handling of the Covid crisis was recognized as excellent by NSW Premier Chris Minns. However, he stressed the importance of public officials reporting conflicts of interest. Berejiklian claimed that she has always acted in the public interest and appreciates the support she has received from the public.

In response to the ICAC report, Optus issued a brief statement confirming its content, but declined to comment further. The report is currently being examined by Berejiklian’s legal team.

Gladys Berejiklian is 52 years old, she was born in Manly Hospital in Sydney. She is the eldest of three daughters and is of Armenian descent. Her parents, Krikor and Arsha, were Armenian immigrants. While ICAC sought advice from prosecutors on potential criminal proceedings against Maguire, they indicated they would not recommend charges against Berejiklian. The report concludes that the Commission does not believe it is necessary to involve the Director of Public Prosecutions (DPP) in the prosecution of Berejiklian for any offence.

Despite this, the corruption revelations have raised concerns about Berejiklian’s position at Optus, Australia’s second largest telecommunications company. Pending the ICAC report, Optus chief executive Kelly Bayer Rosmarin had previously expressed support for Berejiklian, but said the company would reconsider its position based on the published findings.

Bayer Rosmarin stressed that the ICAC investigation related to events that occurred prior to Berejiklian’s tenure at Optus. The company did not expect any revelations that would jeopardize its role, according to Bayer Rosmarin.
