Phillips filed for divorce from Masterson after his verdict.
After denying Masterson bail following an appeal, the judge cited his divorce as a factor, as he could “run away” given he has no family at home.
“If the defendant’s conviction and sentence are upheld on appeal, he will likely remain in custody for decades, and possibly for the rest of his life,” Judge Charlaine Olmedo wrote at the time, according to Deadline.
“In light of the fact that the defendant does not have a wife to go home to, the defendant now has every incentive to flee and little reason to return to state prison to serve the remainder of his lengthy sentence if his appeal is unsuccessful,” Olmedo continued.
