BJP MLA Found Guilty Of Raping Minor Girl, Court Sentences 25 Years Of Imprisonment

Bharatiya Janata Party (BJP) Member of Legislative Assembly (MLA) Ramdular Gaur from Duddhi constituency in Uttar Pradesh has been convicted by the Duddhi Additional District Court for raping a minor girl 9 years ago. Additional District and Sessions Judge Sonbhadra (Uttar Pradesh) sentenced Ramdul Gaur to 25 years imprisonment and fined him ₹ 10 lakh. Additional District Magistrate and Sessions Judge MP-MLA Sonbhadra also ordered that the fine be forwarded to the girl’s family for rehabilitation.

Ramdular Gaur was convicted by the Uttar Pradesh Additional Sessions Court for the crime of rape and threats of grave consequences against his minor sister. The verdict paved the way for the Bharatiya Janata Party (BJP) leader to be disqualified from the Duddhi assembly seat in Uttar Pradesh. The law states that a person sentenced to a prison sentence of 2 years or more is sentenced as of right from the day of conviction and remains sentenced for a further 6 years after serving the sentence. Gaur, a Scheduled Tribe (ST) member, was elected to the Uttar Pradesh legislature from the Duddhi assembly seat in Uttar Pradesh in 2022.

On December 12, the court found Ramdular Gaur guilty. Special Public Prosecutor Satyaprakash Tripathi said the court has registered a case against the Duddhi assembly constituency member. Before the verdict was pronounced, Ramdula Gaura’s lawyer asked the court to give him a minimum sentence. He also said that Gond will provide full support to the rape survivor’s family. Tripathi said that due to the details of the case, the case was registered on November 4, 2014. He added that the case was registered under sections 376 (rape), 506 (punishment for criminal intimidation), 5L/6 and Protection of Children from Sexual Offenders (POCSO).

The incident took place when Ramdular Gaur’s wife was Gram Pradhan, he said. The case was registered by the Myorpur police based on the complaint of the victim’s brother. At that time Ramdul Gaur was not an MLA and the case was in the process of trial in the People’s Court of Ombudsman (POCSO). However, after he was elected as an MLA, the case was transferred to the Maharashtra Pradesh Congress Committee (MP-MLA) court. Duddhi assembly constituency is one of the five assembly constituencies that make up the Robertsganj Lok Sabha constituency, which is reserved for Scheduled Tribe candidates.
