For second-degree manslaughter, Penny, 24, was arrested and handcuffed. He entered no plea while being escorted by police into the courtroom.

Before filing the criminal case, assistant district attorney Joshua Steinglass claimed that prosecutors conducted a “thorough investigation” that involved speaking with witnesses, 911 callers, and responding officers.

Following Neely’s outbursts on an F train on May 1, Penny was shown on video placing Neely in a chokehold. Neely was making threats, according to several witnesses, Steinglass informed the judge. After holding Neely for a while, Neely eventually stopped moving, but Penny kept holding him for a while, according to Steinglass.

Thomas Kenniff, Penny’s defence attorney, claimed that Penny “has been fully cooperative throughout this process.” In a statement to the media, Kenniff stated that Penny “turned himself in here voluntarily and with the sort of dignity and integrity that is characteristic of his dignity of service to this grateful nation.”

In a statement released on Friday, Penny’s attorneys stated, “We fully expect that Danny will be exonerated of all charges.”

One day after the Manhattan district attorney’s office announced that Penny will be arrested for second-degree manslaughter, which carries a potential 15-year jail sentence, Penny turned himself in.

Lennon Edwards, an attorney for the Neely family, is pushing for second-degree murder charges, arguing that Penny should have realised Neely might not survive after witnessing him struggle in the chokehold.

At a press conference hours after Penny surrendered himself in, Neely family attorney Donte Mills further stated that Penny “acted with indifference.” And we cannot allow that to continue.

“For everyone who says, ‘I’ve been on the train and I’ve been scared before, but I can’t tell you what I would’ve done in that situation,’ Ask how you can help, I’m going to tell you,” Mills said. “Pls refrain from violence. Don’t suffocate, don’t kill, and don’t take life.

Mills stated, “We don’t want anyone to be terrified on the tube. “But we want people to ask, ‘Why?’ when they see folks who might be present in that circumstance. And, “How can I change things for them or help them?”

According to police sources, Neely had a known history of mental health issues at the time of his death and was homeless. It is unknown how many of Neely’s arrests for incidents on the tube resulted in convictions. Neely had previously been detained on multiple occasions.

Neely apparently yelled and harassed passengers on the train, according to some witnesses who allegedly called the police. According to police sources who spoke to ABC News, Neely was not directly threatening Penny when he interfered, and neither had he turned aggressive or been threatening anyone in particular.

In a previous statement, Penny’s lawyers expressed their ‘condolences to those close to Mr. Neely’ and asserted that ‘Mr. Neely began aggressively threatening Daniel’, and that the Marine veteran and others ‘acted to protect themselves’.

The statement from the law office of Raiser and Kenniff read, “Mr. Neely had a documented history of violent and erratic behaviour, the apparent result of ongoing and untreated mental illness.” “When Mr. Neely started threatening Daniel Penny and the other passengers forcefully, Daniel took action to defend them until help could arrive. Daniel could not have predicted Mr. Neely’s sudden death and never intended to hurt him.
