Daya Nayak was born on Wednesday, 20 July 1966 (age 56; as of 2022) in Yennehole village, Karkala taluk, Udupi district, Karnataka state. His zodiac sign is Cancer. He studied till seventh standard in the Kannada medium school founded by his grandfather. In 1979, at the age of 13, he came to Mumbai to earn money to support his family after his father disappeared mysteriously. To make money, he worked as a waiter in a restaurant for eight years. Daya wanted to continue his education and seeing Daya’s dedication, the restaurant owner where he worked enrolled him in the Pahadi Municipal School in Goregaon, which was an evening school. He passed his Class 12th examination with 88% and subsequently obtained his Master of Science (M.Sc.) from Walia College of Arts, Commerce and Science (then CES College), DN Nagar, Andheri West, Mumbai. After graduation, he worked as a supervisor for a plumber. He appeared for several government job examinations; however, a chance meeting with some officers from the Narcotics Bureau of Mumbai Police inspired him to join the Mumbai Police.

Daya Nayak joined the Mumbai Police in 1995 and after completing one year of training, she was posted to Juhu Police Station in 1996. On the night of December 31, 1996, he received information about two members of the underworld Don Chhota Rajan gang. When he went to arrest them, they started shooting at him and in the ensuing encounter, he killed both of them. After this encounter, he feared the police department might suspend him; however, the department rewarded him for killing the gangster. In 1997, he was transferred to the team of Encounter expert Pradeep Sharma. On December 12, 1997, he received information about Sadiq Kalia alias Narsimha, a wanted criminal and gangster gunman of Don Chhota Shakeel gang in Dadar Flower Market, and when he went to arrest him, he shot at him, hitting him with bullets. Shot Daya in his thigh; however, he also shot and wounded Nasimha. Narasimha’s associates threw a bomb at him; however, he suffered only minor injuries and remained in the hospital for 17 days. He was later transferred to the Andheri (East) Criminal Investigation Cell. In 2002, he was transferred to Kandivali police station. In September 2019, he was promoted and posted to the Mumbai unit of the Maharashtra Anti-Terrorism Squad (ATS). He was suspended several times amid accusations of false encounters, corruption and links to underworld bosses. However, he has always maintained that he has never done anything wrong and has never been accused of any illegal activity. In 2003, journalist Ketan Tirodkar accused Daya of having ties to the underworld and amassing wealth disproportionate to his income. Ketan also claimed that he befriended Daya in 2002 and ran an extortion business with him. On December 3, 2004, Daya was accused of corruption worth Rs 41.75 million and was investigated by the Maharashtra Organized Crime Control Authority (MCOCA). He was suspended from service in January 2006 and He was arrested by the Anti-Corruption Bureau on February 20, 2006 after his request for bail was rejected. In April 2008, journalist Ketan Tirodkar filed a complaint against him, accusing him of describing Sadiq Jamal as a terrorist. Kotan claimed that he contacted Daya to help Sadiq get out of a criminal case of gambling and assault registered in Bhav Nagar, Gujarat; however, Daya detained Sadiq in 2002 and tortured him in custody, He was forced to declare that he was a terrorist whose mission was to assassinate Indian Prime Minister Narendra Modi, who was the Chief Minister of Gujarat at the time. Kotan claimed that Daya handed over Sadiq to the Gujarat police, who asked Daya to provide a Muslim youth. Sadiq Islam was killed in a fight on the night of January 13, 2003.

In January 2014, he was transferred to Nagpur; however, he refused to go to Nagpur citing fear for his life and that of his family. He claimed criminals could kill him there. He was suspended by then Maharashtra Inspector General of Police Sanjeev Dayal in July 2015 when he failed to perform his duties. He was reinstated in January 2016 by then police commissioner Praveen Dixit.
Asking for bribes to file false drug case
Daya Nayak was posted to Amboli police station in 2019 when he intercepted a consignment of sandalwood and arrested Syed Inayat Ali as a suspect in the case Sayed Inayat Ali Yawar Abbas, also known as Muhammad. Nayak allegedly asked Mohamed for money, and Mohamed discussed the matter with friends. His friends Mohammed Wasim Abdul Latif Shaikh, Mustafa Zulfiqar Charniya and Tanveer Abdul Aziz Paryani complained to the Anti-Corruption Bureau (ACB) about Nayak demanding bribes, and the ACB laid a trap and caught Daya red-handed. Refusal to transfer to Gondia
On May 6, 2021, Daya was transferred to Gondia district and further attached to the District Caste Scrutiny Committee (DCSC) on the orders of Acting Director General of Police (DGP) Sanjay Pandey; however, he appealed against the decision. On May 12, 2021, the Maharashtra Administrative Tribunal (MAT) stayed his transfer and he rejoined the anti-terrorism squad of Juhu unit in Mumbai.

- Before joining the Mumbai Police, he had cleared six government examinations, including that of State Bank of Hyderabad, Sales Tax Inspector and Air Traffic Inspector of India.
- When he worked as a waiter in a hotel, he earned 700 rupees a month, including tips, and he often sent 500 rupees to his mother in Karnataka.
- When he worked as a plumber, he earned Rs 3,000 per month.
- He scored 194 out of 200 marks in the Mumbai Police interview and 100 marks in the run. He dropped a few points in the shot put. He came first in the police selection examination.
