In 2007, Daya Shankar Singh contested the Uttar Pradesh Legislative Assembly elections from Ballia constituency on the ticket of the Bharatiya Janata Party, but failed. In March 2022, he once again contested the Uttar Pradesh Legislative Assembly elections in Ballia Nagar constituency on the name of the Bharatiya Janata Party. He defeated Narad Rai of the Samajwadi Party by 26,239 votes and became a member of the Uttar Pradesh Legislative Assembly. He was appointed Minister of Transportation and took office on March 25, 2022.

On July 20, 2016, Daya Shankar Singh made a controversial statement against BSP national president and former chief minister Mayawati, calling her worse than a prostitute. Because she sold party tickets to candidates for the 2017 parliamentary elections. He was suspended as Uttar Pradesh vice-president by the BJP for six years and expelled from the party. Later, an FIR was lodged against him for making derogatory remarks against Mayawati. Soon after the FIR, he fled to avoid being caught. However, he was detained on July 29, 2016, in Buxar district of Bihar. He was taken into judicial custody in Mau City, Uttar Pradesh. In August 2016, his wife Swati Singh had threatened the BSP leader against her 12-year-old daughter and mother-in-law under Section 120B (punishment for criminal conspiracy) and Section 153 A (promoting enmity) File a complaint. IPC Sections 504 (intentional insult with intent to breach the peace), 506 (punishment for criminal intimidation) and 509 (words, gestures or conduct insulting the modesty of a woman). On August 6, 2016, Daya Shankar was released on bail in the Mao defamation case. In March 2017, Swati Singh won the Uttar Pradesh Assembly elections and the suspension of her husband Daya Shankar was revoked. Mahindra and Mahindra deputy manager Subodh Kumar Singh filed a fraud case against Daya Shankar Singh and his brother for allegedly providing a false bank guarantee of Rs 60 lakh in 2014 for the acquisition of the agency’s dealership in Haibatpur, Uttar Pradesh.
