Devendra Kumar Upadhyaya started his career as a lawyer in 1991 by joining the division bench of Allahabad High Court Senior Advocate Mohd Arif Khan. In 1997, he transferred to the Chamber of Commerce of Senior Attorney SK Kalia. Upadhyaya was appointed as the Principal Standing Counsel to the Lucknow Bench of Uttar Pradesh Government in 2007. During his legal practice, Devendra Kumar specialized in civil and constitutional matters. On November 21, 2011, Devendra Kumar Upadhyaya was elevated to the post of Additional Judge of the Lucknow Bench of the Allahabad High Court.
He was sworn in as a permanent judge of the Allahabad High Court on August 6, 2013. In March 2023, Upadhyaya was appointed as the senior judge of the Lucknow bench of the Allahabad High Court, making him the third senior judge of the court. He is also a member of the Administrative Committee of Allahabad High Court. On July 5, 2023, the Supreme Court bench comprising Chief Justice of India DY Chandrachud and Justices SK Kaul and Sanjiv Khanna in its resolution proposed the appointment of Justice Upadhyaya as the Chief Justice of the Bombay High Court. The recommendation letter reads:
The post of Chief Judge of the Bombay High Court recently fell vacant due to the retirement of Justice Ramesh D. Dhanuka. Therefore, an appointment is required for this office. It is recommended that Justice Devendra Kumar Upadhyaya be appointed as the Chief Justice of the Bombay High Court. “
