In May 2001, Fardeen Khan was arrested by the Narcotics Control Bureau (NCB) for trying to buy one gram of cocaine in Juhu, Mumbai. The NCB claimed that 9 grams of cocaine were found on an alleged drug dealer named Nasir Abdul Karim, who was also arrested in connection with the case. Fardeen insists he never possessed the drug and was only trying to buy a gram. In January 2008, the NDPS special court charged Fardeen with trying to purchase just one gram of cocaine. The charge is significant because it allows him to seek relief under Section 64(a) of the NDPS Act, which allows individuals charged with minor drug offenses to undergo a rehabilitation program at a government center rather than face punishment. The case is still ongoing and on 2 November 2001, the court scheduled further pre-trial steps in which the prosecution will provide witness lists and original documents for the upcoming trial. Fardeen’s lawyer Ayaz Khan told the court he did not object to the charge of trying to buy a gram of cocaine. This quantity is within the legal scope for personal consumption and does not constitute a commercial quantity. He also clarified that Fardeen’s defense was never based on lies and the actor’s father, late actor Feroze Khan, was against any false defense tactics. The court reiterated that once the charge of attempting to purchase a gram is established, Fardin can seek relief under Section 64(a) of the NDPS Act, which would enable him to undergo an addiction recovery program at a government centre. Fardeen’s drug possession charges were later dropped in 2012 and he was cleared for the case after completing a detoxification program at KEM Hospital. But he was warned that his immunity would be revoked if he was found to be in possession of drugs in the future. The legal provision of Section 64A of the NDPS Act allows individuals accused of drug-related offenses to seek drug dependence treatment at government-recognized institutions. Fardeen Khan expressed relief and confidence in the judiciary, stressing that based on the facts and evidence of the case, he was only accused of trying to purchase one gram of cocaine. Overall, the legal proceedings resulted in Fardin being charged for attempting to purchase a gram of cocaine, allowing Fardin to seek relief through an addiction recovery program and ultimately obtain immunity from further penalties.

In the meantime, Fardeen also bought a car, the monthly cost of which was as high as 22,000 rupees. He had so little savings that he couldn’t even afford the gasoline for the car.
