The Trump 2016 presidential campaign and chief prosecutor Jessica Denson today filed a proposed settlement that would permanently exonerate all campaign staff previously forced to remain silent.
The Trump campaign acknowledges that the non-disclosure and non-disparagement clauses in the form agreement (“NDA”) signed by all members of the 2016 campaign are invalid and unenforceable under the terms of the settlement agreement, and the campaign acknowledges that the precedent of Ms. Denson’s victory over the NDA in March 2021 must apply to all signatories.

Importantly, the settlement goes beyond the Campaign’s recent concessions in this action, ensuring that the NDA is permanently invalidated for the entire class and that the invalidation has legal force. The terms of the agreement are in effect pending court approval.
“The Trump campaign’s illegal NDAs are the centerpiece of his up-and-down authoritarian dream world, where silencers are celebrated as champions of free speech, those who weaponize the justice system claim to be their victims, and supporters of would-be dictators scream ‘Freedom,'” said Jessica Denson, who filed the first NDA cancellation lawsuit in 2018 as a pro se litigator.

The parties urged the Court to issue an order permanently barring any application of the unconstitutional clauses against all former campaign workers to ensure that they are never enforced.
All former employees, independent contractors, and volunteers will now be able to express their views on the campaign without having to worry about anyone, including Donald Trump, enforcing an NDA. This is pending judicial approval. A former Trump campaign employee named Jessica Denson filed a class action lawsuit, which would be resolved in a settlement. Protect Democracy’s John Langford welcomed the proposed agreement to ensure the protection of anyone who has signed the NDA form used by the Trump campaign and to prevent future political campaigns from using too broad speech restrictions. The proposed settlement announced today would be a victory for Jessica, the signatories to this NDA, and our democracy.
This follows logically from some of the most significant First Amendment cases, which have shown that the unfair use of contract law to silence critics is just as problematic as the unfair use of libel law. A key and lasting precedent has already been set in Jessica’s case: “Our deep national commitment to the principle that public affairs debate should be free, robust and open is anathema to unlimited NDAs involving candidates and public officials.”
