Suicide or murder?

Jiah Khan’s mother Rabia Khan has claimed Jiah’s death was murder, accused Sooraj Pancholi of crimes and raised concerns of financial impropriety involving money and jewellery. . According to Rabia, Jiah gave Sooraj a large amount of money to buy jewelry for her sister’s 21st birthday, but Sooraj never provided the jewelry or updated Jiah on the status of the money. Although Sooraj apologized and sent flowers, which Jiah refused, she confronted him about the money; the outcome of this confrontation remains undisclosed. Rabia also revealed that Jha shared the biometric lock of her apartment with Suraj, raising suspicions about his involvement in her death. Suraj, on the other hand, claimed that Jia was battling depression and that he had tried several times to help her overcome it. He also claimed that he informed Rabia of Jia’s condition but she failed to take action, leading to Jia’s suicide.

On June 7, 2013, Mumbai police found a suicide note at Jiah’s residence, in which Jiah mentioned aborting a baby whose father was allegedly Sooraj Pancholi, son of veteran actor Aditya Pancholi. She also expressed her disappointment at not getting the love she expected and deserved from Sooraj. The letter also details the emotional and physical abuse Jia suffered during her relationship with Suraj.

According to the suicide note, Sooraj Pancholi was arrested on June 10, 2013 on charges of abetment to suicide under Section 306 of the Indian Penal Code (IPC); however, the Bombay High Court granted him bail on July 1, 2013, stating that he could not Take full responsibility for an incident.

On October 1, 2013, Rabia filed a complaint in the Bombay High Court alleging the murder of her daughter Jahan and requested a Central Bureau of Investigation investigation into the case. On July 2, 2014, the case was handed over to the CBI, which subsequently filed charges against Sooraj Pancholi. In 2016, the CBI ruled out any possibility of foul play and informed the High Court that Jiah Khan’s death was a suicide. Rabia has since hired a British forensic expert named Jason Payne James, who claims that Jia’s death was “carefully planned.” Rabia then approached the Bombay High Court, requesting the Special Investigation Team (SIT) to take over the case; however, the Bombay High Court rejected her plea in February 2017.

In September 2017, Rabia Khan wrote to Prime Minister Narendra Modi seeking justice. She then moved a request to the CBI special court in Mumbai for further investigation into the case, but it was rejected. In 2021, Jiah’s case was reassigned to a CBI special court after the session court claimed it lacked jurisdiction following a CBI investigation. In 2022, the Bombay High Court dismissed Rabia’s petition seeking a fresh investigation into the case. On April 28, 2023, the CBI Special Court in Mumbai acquitted Sooraj Pancholi in the Jiah Khan suicide case due to lack of evidence. In its verdict, the court said the evidence against Sooraj Pancholi was “vague and general” and Jiah was “a victim of her own emotions”. CBI Special Court Judge AS Sayyad noted that Jiah was suicidal and only Sooraj Pancholi knew about it. The judge further said that Sooraj was unable to devote time to Jiah as he was focused on his acting career and Rabia’s attempt to prove that Jiah did not commit suicide but was killed contradicted the prosecution’s allegations and ultimately undermined the prosecution’s case . AS Sayyad stated within its jurisdiction,

In this case, it cannot be ignored that the deceased had suicidal tendencies. She had attempted suicide earlier and the accused called a doctor. The defendant treated her and tried to get her out of her depression. At the time, the defendant was engaged in an acting career and was unable to devote sufficient time to caring for the deceased. However, the defendant saved her the previous time when she attempted suicide and helped her out of her depression. Through her evidence, Rabia attempts to prove that Jia never committed suicide but was killed by the accused (Pancholi). However, this was not the case for the prosecution. When prosecutors alleged a suicide, Rabia always claimed it was murder. By presenting such openly contradictory evidence, the complainant himself destroyed the prosecution’s case. “

After the court verdict in the Jiah Khan murder case, Rabia Khan said Suraj Pancholi was not charged with abetment to suicide but abetment to murder. In an interview, Rabia said in response to the verdict that she planned to challenge the decision in the High Court.
