About $18 million will be paid to a man whose conviction was vacated after serving more than 25 years in prison for a notorious pipe stabbing.
In 1990, a group of men, including 50-year-old Johnny Hincapie, were accused of murdering Brian Watkins, a 22-year-old tourist from Utah, in the East 53rd Street subway station. However, Hincapie claimed that he was forced to make a false confession.
When a group of armed robbers surrounded Watkins and her parents, they had just arrived in Manhattan from the US Open tennis tournament.
Hincapie recanted, but a state judge upheld the conviction and sentenced him to 25 years to life in prison, which he ended up serving 25 years, three months and eight days before being acquitted for lack of evidence.
In January 2017, Hincapie’s conviction was overturned. Hincapie filed a lawsuit against the city in April 2018 alleging that the police who arrested him used “unconstitutional tactics to declare ‘case closed’ within twenty-four hours.”
Under the terms of the agreement, the state would pay $4.8 million and the city would give Hincapie $12.8 million.
A representative of the municipal legal department said: “This agreement resolves a long-running civil case involving a heinous crime.” “Based on the Attorney General’s findings and our review, we believe this settlement is fair and in the best interest of all parties.”
Although Watkins is still on her mind, Hincapie says she can’t wait to move on with her life. He noted, “I have never forgotten the pain his family went through. “I am happy that my city and state have finally recognized my innocence and I look forward to the next chapter of my life with my family,” the defendant said.
