In a statement issued through attorneys, the family of Jordan Neely, a Black man who passed away on a New York subway train after being put in a chokehold by another passenger, chastised the rider for not expressing “an apology or expression of regret.”

The Neely family claimed in a separate news release on Monday that Daniel Penny’s attorneys’ statement was “a character assassination” and “a clear example of why he believed he was entitled to take Jordan’s life” Daniel Penny is a white 24-year-old former US soldier from Long Island.

A week prior, Jordan Neely, 30, passed away. Protests in New York have been sparked by his passing and the fact that Penny was not charged.

For failing to label Neely’s death “what it is: a modern-day public lynching,” Maurice Mitchell, director of the left-leaning Working Families party with its headquarters in Brooklyn, attacked New York Governor Kathy Hochul and New York City Mayor Eric Adams.

In a statement, Penny criticised government inactivity on homelessness and mental health issues, claiming elected politicians showed “indifference” to people like Neely who face these difficulties.

The statement claimed Neely had “a documented history of violent and erratic behaviour, the apparent result of ongoing and untreated mental illness”, and that his hostile behaviour had led riders to take action.

Neely was included among the homeless individuals the city felt required assistance the most urgently, according to The Times.

The Neely family stated: “Penny says that society as a whole has demonstrated ‘indifference’ for individuals like Jordan, although he is more accurately described by that term himself.

“It is evident that he is the one who acted carelessly, both when he killed Jordan and now in his first statement to the public. He never once made an effort to assist him. “In short, his behaviour on the train and his recent words demonstrate his need to be imprisoned.” Additionally, Neely’s family suggested Mayor Adams call them.
