People knowledgeable on the situation told CNN that former U.S. President Donald Trump’s lawyers are engaged in a covert legal struggle to prevent a federal grand jury from inquiring of an expanding group of close Trump associates about his attempts to rig the 2020 election.
The high-stakes legal dispute, in which three Trump attorneys appeared at the federal courthouse in Washington, D.C., on Thursday afternoon, is the former American President’s most aggressive attempt to assert executive privilege and attorney-client privilege in order to stop some witnesses from disclosing information about the criminal investigation’s events surrounding Jan. 6, last year.
For Trump’s post-presidency legal problems, the court battle over privilege, which has not previously been published and is under seal, represents a turning moment.
Depending on how the case is decided, prosecutors may or may not be able to breach the wall that Trump has erected around the talks he had with his legal counsel while he was working to rig the 2020 election and in the West Wing.
According to the people briefed, this issue surfaced when former Trump White House adviser and attorney Eric Herschmann was served a grand jury subpoena.
Other former senior Trump White House employees, such as former White House counsel Pat Cipollone and his deputy Patrick Philbin, have recently testified before the grand jury after agreeing on particular topics they would not discuss due to Trump’s assertions of executive privilege.
Herschmann isn’t contesting the subpoena in court by himself. Instead, Trump’s legal team is requesting that the judge accept the former President’s claims of privilege and the right to privacy regarding his dealings. The grand jury testimony for Herschmann has been postponed.
If prosecutors plan to utilise the evidence in potential prosecutions against Trump or others is still unknown.
