Violation of model code of conduct
In April 2014, Bharatiya Janata Party (BJP) candidate Kirit Somaiya filed a complaint in the Bombay High Court alleging violation of the model code of conduct. Somaiya, who is contesting from Mumbai Northeast constituency, is seeking votes based on caste, community and language preferences, according to petitioner Nikunj Dave, a resident of the constituency. Despite repeated complaints, the petitioner alleged that both the Election Commission and police officials neglected to take any action against Kirit.
Sanjay Raut’s defamation complaint
On June 12, 2023, Congress MP and Shiv Sena Uddhav Thackeray leader Sanjay Raut filed a criminal defamation case against Kirit Somaiya in a Mumbai court. Rutter’s complaint was in response to Somaiya’s tweet specifically targeting Rutter. In his plea, Rutter claimed that Somaiya had been posting defamatory statements on his Twitter account since 2022. Rutter believed the comments were baseless and aimed at damaging his reputation. He said,
I was shocked and surprised when I noticed that Somaiya posted defamatory remarks against me on his Twitter account. His Twitter account attempted to damage my reputation in society and the public eye by making defamatory statements about me without any rigorous evidence. “
Raut maintained that the remarks were aimed at maliciously tarnishing his public image and stressed that the tweets were still accessible on Somaiya’s social media pages, further supporting his allegations. Raut said it was the same as defamation of character without any evidence,
Somaiya’s remarks were damaging and amounted to defamation of character without any evidence. Such malicious remarks, without any documents or evidence, show Somaiya’s completely irresponsible attitude. “
Based on these circumstances, Rathe filed an appeal before the Mulund Magistrate, Mumbai, urging them to admit the offense under Sections 499 and 500 of the Indian Penal Code. Raut requested the court to summon Somaiya as an accused in the criminal defamation case.
Misappropriation of funds
Kirit Somaiya was held accountable for misappropriating Rs 5.8 million raised through crowdsourcing to prevent India’s first aircraft carrier Vikrant from being scrapped. Although the ship was ultimately condemned, Soumaiya failed to return the funds to the individuals who enthusiastically contributed to saving the ship. In 2022, a lawsuit was filed against him over the matter.
Claims attack by Shiv Sena activists
In April 2022, Kirit Somaiya claimed that he was physically attacked by 70 to 80 Shiv Sainiks outside the Khar police station in Mumbai, who hurled stones, bottles and shoes, which later sparked a controversy. Amravati MP Navneet Rana and her husband MLA Ravi Rana were detained by the police. He also accused the Mumbai Police of showing undue respect to the Uddhav Thackeray-led Maha Vikas Aghadi (MVA) government. He wrote in a series of Twitter posts,
Shiv Sena goondas (rioters) pelted a lot of stones at Khar police station. My car window was broken and I was injured and was rushing to Bandra police station. I was shocked that 100 Shiv Sena policemen attacked me with stones in the presence of 50 policemen at Khar police station campus. Want to kill me. What is the police chief doing? How could so many Mafia Sena Gondas be allowed to gather in a police station? “
