One of the country’s leading constitutional experts reaffirmed before a parliamentary consultation that an indigenous voice in parliament will not impede government action or obstruct the justice system.

Reporting to the parliamentary committee dealing with the referendum, Professor Anne Twomey again downplayed the concerns of Conservative critics who feared the vote could trigger ongoing legal challenges.

Ahead of the committee’s first hearing in Canberra on Friday, Twomey said in a presentation to the inquiry: “There is no obligation on Parliament or the executive to respond to objections.” [from the voice] or implement them.” “No prior consultation is necessary. The executive government of parliament can take action without a prior request for representation.

Tom Calma and Marcia Langton, indigenous leaders who chaired the co-design voting process under the previous coalition government, will be among the witnesses at the first joint select committee hearing on the Aboriginal and Torres Strait Islander voting referendum.

Witnesses will also include advocates for the voice Thomas Mayo, former ABC host Kerry O’Brien and attorneys Louise Clegg and Douglas Drummond KC who have voiced their opposition to the voice.

Twomey will be among a group of eminent constitutional lawyers to testify before the committee, all of whom strongly defended the vote or dismissed questions about the validity of their arguments.

Nita Green, the Labor senator who chairs the committee, said the committee was not responsible for deciding whether something should pass or fail. Instead, they will think about the possible legal consequences of the vote. She declared: “We are not going to vote in a bigger referendum. “That will be for the Australian people to decide, not the politicians,” Green said, expecting coalition committee members to try “to change their party’s position” on the vote during the inquiry.

In order to obtain the views of indigenous communities and people involved in the processes that resulted in the ballot proposal, hearings will be held in Orange, Cairns and Perth.

Father Frank Brennan, a voice advocate, suggested in his submission that the phrase “executive government” be changed to “ministers of state” because he is concerned about the voice advising the executive branch of government. According to Brennan, there could be a duty for the voice to be informed of upcoming administrative decisions and have their representations considered.
