News from Michelle Lodzinski
On March 16, 2016, Gerald Krovatin testified before 17 jurors that his client Michelle Lodzinski did not “intentionally and knowingly” contribute to the 1991 death of her firstborn, Timothy Wiltsey.
Lodzinski, according to Krovatin, was not the monster he was portrayed to be. She was a good mother who adored her son and she never admitted to anyone that she killed the boy, including family, friends, the police or the FBI.
He claimed there was no evidence linking Lodzinski or his son to the blanket that was discovered in 1992 alongside the boy’s bones at the Raritan Center, Edison. There are no eyewitnesses, no cause of death and no history of abuse, she claimed.
If the dots lead nowhere, you can’t connect them, Krovatin believes. “In this case, it is impossible for the state to establish murder.”
Three months later, a jury found Lodzinski, a former single mother from South Amboy, guilty of her son’s murder. It was one of the most famous and longest-running cold cases in Middlesex County. Lodzinski was sentenced to 30 years in state prison in January 2017.
Despite this, Krovatin persisted in defending Lodzinski, and the New Jersey Supreme Court on Tuesday reversed his conviction after concluding that there was no direct or circumstantial evidence at trial to indicate that Lodzinski intentionally or knowingly caused his son’s death. .
After being released hours later from the Edna Mahan Correctional Center for Women in Hunterdon County, Lodzinski, 54, gave a short speech thanking everyone who supported her and worked to get her back to her loved ones. She has two other children and intends to return to Florida.
A partner at Fox Rothschild with offices in Morristown and New York and co-chairman of the firm’s White Collar Criminal Defense and Compliance Practice Group, attorney Matthew S. Adams said Tuesday’s Supreme Court decision is significant and represents a rare use of power to vacate a jury’s conviction.
