As a member of the Indian National Congress, Jindal became the power minister in the Haryana government. He won the Haryana Hisar Legislative Assembly seat for the third consecutive time. The legal case involves Shri Om Parkash Jindal and his son, who challenged the conduct of tax officials who raided their home in Hisar on June 6, 1974 and seized jewelery and other items. Another search on 12 July 1974 resulted in the reassessment and storage of the seized items. The petitioners argued that the search warrant was unlawful, that items were taken from persons not named in the warrant, and that there were delays in following proper procedures. They also claim officers acted with improper motives. The court discussed Section 132(3) of the Income Tax Act and observed that this section should be used only when the officer is of the opinion that the items are not disclosed but faces a challenge to immediate seizure. The officials argued that since the statement of Shri Om Prakash Jindal was yet to be verified, they withheld the items instead of seizing them. The court criticized officials for being hesitant about the undisclosed nature of the items and stressed that they cannot keep seized items indefinitely. Courts recommend that a reasonable retention period be approximately 30 days. Accordingly, the court ordered that the seals and locks in the warehouse be removed and directed that the seized items be returned to Shri Om Prakash Jindal within ten days. Officials have equal time to decide whether there is reason to believe the projects have not been made public. If seized within this period, further action will be taken. The Court granted relief to the petition in this regard only, at each party’s costs.
