Pauly Shore is facing a lawsuit.
Shore, 55, is being sued in Los Angeles by two plaintiffs who allege assault and battery on a security employee at The Comedy Store, which Shore owns, over an incident that occurred in November 2022, according to legal documents obtained by PEOPLE.
Sean Kehoe and his daughter Kirra Lyn Potts claim a member of club security “violently grabbed and assaulted” Kehoe and dragged the man away. They also allege that Shore, whose family owns and operates the gym, was aware that club security was planning the attack and that he “agreed and encouraged” employees in the incident.
A representative for Shore did not immediately respond to PEOPLE’s request for comment on Friday.

Kehoe and Potts are seeking damages for their past and future medical bills, lost earnings and alleged physical and mental injuries as a result of the incident. Kehoe alleged in the lawsuit that the incident caused him “severe injuries,” and both plaintiffs claim they faced “mental and emotional distress” as a result of the incident.

The new lawsuit against Shore comes about a week after news broke that he would play fitness guru Richard Simmons in an upcoming Warner Bros. feature. The Wolper Organization, as The Hollywood Reporter and other points of sale reported. Shore previously publicly shared his interest in playing Simmons, 75, back in September 2023, when he wrote in response to a viral Instagram meme: “I can definitely turn into this guy.”
“We all need this biopic now more than ever,” Shore said in a Jan. 17 statement announcing the film. “Simmons represented mental health, getting people in shape and being my authentically silly self! Whenever he was on TV, you could never take your eyes off him, and he brought such joy to his appearances that it was nothing but a good time.”

Sam Simmons, who has not been seen in public for nearly 10 years, shared in a rare message posted on his Facebook account that he “never gave my permission to make this movie.” “I don’t have a manager anymore, and I don’t have a publicist either. Just trying to live a quiet life and be calm,” he wrote in the post. “Thank you for all your love and support.”
Shore previously played Simmons in a short film titled Court madmanwhich premiered at the 2024 Sundance Film Festival in Park City, Utah last week.
