Although the hedge fund billionaire flew Judge Samuel Alito on a private jet during a lavish trip they took in 2008, since then the businessman has regularly asked the Supreme Court to intercede on his behalf, according to ProPublica.

Before the report was published Tuesday night, Alito took a very unusual step: He wrote an op-ed for The Wall Street Journal in which he acknowledged knowing millionaire Paul Singer but downplayed their relationship.

The new report adds to a growing list of ethical concerns about the court that Democrats in Congress have made a top priority. After the senators returned from recess on July 4, Senate President Dick Durbin, D-Ill., said his committee would review the Supreme Court’s ethics bill.

According to ProPublica, Singer used a private jet to fly Alito to Alaska, and Justice did not disclose the trip or flight in his annual financial disclosure form or disqualify himself from hearings on matters involving Singer’s hedge fund. The billionaire’s hedge fund “went to court at least ten times in cases where his role was often absent” in the years after the 2008 trip.

“In 2014, the court decided to resolve a key dispute in the ten-year conflict between Singer’s hedge fund and the Argentine state. Alito did not relent and supported Singer by a 7-1 majority. In the end, the hedge fund coverage received $2.4 billion, according to ProPublica.

CNN has contacted the Supreme Court and Singer’s business for comment. Alito made the extraordinary decision to respond prematurely to the ethics allegations against him hours before the ProPublica article was published.

The Supreme Court’s chief spokesman reportedly told ProPublica Tuesday that Alito would not respond after ProPublica said it sent Alito “a list of detailed questions last week.”

With the exception of “small conversations” on a fishing trip 15 years ago, Alito claimed in his op-ed that he had spoken with Singer “on no more than a few occasions” and that ProPublica’s allegations against him “were not valid”.
