A US judge has asked one of the top US government departments to hand over Prince Harry’s immigration papers.

The Duke is fighting to stop the release of the documents after concerns were raised about his visa application.

The case was launched by the think tank after Harry claimed in his memoir Spare that he took coke, weed and magic mushrooms.

The Heritage Foundation claims that the release of the documents will prove whether Harry lied about his past drug use in his visa application.

They say that if the Duke lied, he could be in violation of US federal law and should lose his immigration status.

US government lawyers argued that Harry’s claims about the drugs in the explosive book were “not proof” that he had actually taken them.

The Department of Homeland Security, which oversees immigration, says making Harry’s documents public would violate his privacy.

In its legal filing, DHS said the records in question were “particularly sensitive” because they would “reveal Harry’s (immigration) status in the United States.”

DHS also argued that Harry still has a right to privacy despite being a celebrity.

But Judge Carl Nichols today asked the officials to hand over the documents, saying their privacy argument was “insufficiently detailed”.

He also wants the ministry to explain the “special harm” that would result from the disclosure of the forms.

Heritage Foundation attorney Samuel Dewey previously accused the US government of “giving special treatment to celebrities” to enter the US.

A conservative think tank says it is in the public interest to make Harry’s visa application public.

Heritage argued in legal filings that Harry being so open about his private life meant he had lost that right.

Lawyers for the Biden administration rejected the claim of special treatment.

Judge Nichols gave DHS until March 21 to file its statements.

It comes after Donald Trump waded into controversy by suggesting he could kick Harry out of the US if he wins a second term.

The former president said he “wouldn’t protect” Harry because he “betrayed the Queen”.

Trump said Harry “will be on his own” if he wins the election in November.
