Woman Sues Hershey’s for $5 Million over ‘Deceptive’ Reese’s Halloween Pumpkins Without Faces

Florida woman is suing Hershey’s Company over “misleading” candy packaging.

Cynthia Kelly of Tampa Bay filed a class action lawsuit in the Middle District Court of Florida against the candy company for $5 million.

According to the complaint shared by WFLA, Kelly says she and other consumers purchased Reese’s Peanut Butter products based on “false and misleading advertising.”

She claimed that several of Reese’s products were supposed to have “explicitly carved artistic designs” but found “no such carvings in the actual products”.

The lawsuit showed examples through images of products, including Reese’s Pumpkin; the packaging had a jack-o’-lantern design, but the actual chocolate inside had a blank face. Similarly, Reese’s White Ghost chocolate had eyes and a mouth on the packaging, but not on the treat.

The complaint then states that Kelly found the product at an Aldi in Hillsborough County, Florida. She bought Reese’s Peanut Butter Pumpkins, which she thought “had adorable carvings,” according to the complaint, for $4.49. But when she opened it, she says that there was no such design on the chocolate.

“Hershey’s product labeling is materially misleading and numerous consumers have been deceived and misled by the images on the product packages,” the complaint states.

PEOPLE reached out to Hershey, but they declined to comment.
