Representative Zephyr will keep her seat, but the law prohibits her from being in the galleries, in the lobby or on the floor of the House. She will be limited to participation in the distance vote.

Rep. Zephyr’s actions put lawmakers and staff “at risk of harm,” according to Republican Majority Leader Sue Vinton, who made the request, in her statement to the Legislature during Wednesday’s hearing.

The action is the latest escalation in the controversial culture war currently being waged over transgender rights in the United States.

Additionally, it is the second time in recent memory that the Republican-controlled legislature has taken action to censure Democratic politicians for speaking out against measures passed by conservatives. Tennessee Republicans voted earlier this month to oust two black Democrats who organized a House rally in support of gun control in the days after the horrific massacre.

The first openly transgender legislator elected in the state of Montana is Representative Zephyr, who represents the Missoula area. Rep. Zephyr is one of the few transgender parliamentarians now serving in US state legislatures. He claimed Wednesday that the LGBT community has been “systematically” targeted by the Montana Legislature.

I was not exaggerating when I stood up and said that your hands are bloody, he said. “I was talking about the real effects of the votes that we have cast as legislators in this body,” the speaker said.

He went on to say in a lengthy statement: “While the vast Republican majority voted me out of the debate, I remain steadfast in my commitment to my community.” His comment last week quickly angered conservatives.
