Artem Chigvintsev Was Not Returning for New Season of Dancing with the Stars Before Arrest

Artem Chigvintsev will not return to the ballroom.

PEOPLE has learned that there are no plans for the pro to participate in Season 33 Dancing with the stars before the arrest on Thursday 29.8.

Chigvintsev was arrested on a charge of felony battery to a spouse in Napa Valley, California. His bond was set at $25,000 and he was released later that day.

The decision to have Chigvintsev sit out the upcoming season is not unusual, as professional dancers often change seasons based on celebrity casting.

The full cast for the new season of the ABC dance competition will be announced at a later date. Olympic bronze medalist Stephen Nedoroscik was the first celebrity competitor to be announced.

Chigvintsev has competed in the last 12 seasons of the show — including the last four. He was recently in a relationship with his ex Bachelor Charity Lawson, fourth in the competition.

He and season 29 partner Kaitlyn Bristowe, who also hosted Bachelorwon the 2020 mirrorball trophy.

Chigvintsev met his wife Nikki Garcia (formerly Nikki Bella) in 2017 when they were together in the 25th season of the show Dancing with the stars. At the time, Garcia was still in a relationship with then-fiancé John Cena, but the couple broke up a year later.

The retired WWE wrestler later reconnected with Chigvintseva that same year, and the two finally confirmed their romance in March 2019. They announced their engagement eight months later, and welcomed their first child together, son Matteo, in July 2020.

The Dancing with the stars Pro was arrested shortly before 10 a.m. on Thursday, August 29. He was then booked into the Napa County Jail less than an hour later and released later that day.

The booking code shows that Chigvintsev is charged with corporal injury to a spouse and has bail set at $25,000, according to booking records obtained by PEOPLE. It has not yet been confirmed, but given the accusation, Chigvinstev’s wife Garcia is likely the spouse in question.

Season 33 of Dancing with the stars will premiere Tuesday, September 17 at 8:00 PM ET on ABC and Disney+, and the episode will be available to watch the following day on Hulu.
