A FOREIGN rapist who said he didn’t know sex with a sleeping woman was wrong can’t be deported – because he says he’s bisexual.

A 41-year-old man would be targeted by violent gangs because of his sexuality if he returned to his native Jamaica, a specialist court was told.

The beast, who has also been given anonymity for his own protection, was sentenced to seven years in prison in 2018 for raping at a party.

He was released in June 2021 after serving half — and was then served with a deportation order.

He was declared a “danger to the community” by the Home Office and should be sent home under the 2002 Asylum Act.

But that decision was contested by the migrant, who was brought to the UK by a relative in 2001 after being the victim of several attacks in Jamaica because of his sexuality.

The man – referred to as AA – told the tribunal the thugs attacked him with “a metal bar, a machete and dogs”.

And the older man he was in a relationship with was later killed because he was gay, it was said.

The expert told the court AA would be a “targeted hit” if he returned.

However, the Home Office insisted it could only find evidence that AA had been involved with women since he came to the UK at 18.

Judge Mulready concluded that the rapist had shown “substantial evidence of positive rehabilitation” and was “motivated not to repeat the threat of a return to prison”.

She said he would be allowed to stay based on his sexuality, even if she decided he was still dangerous.

A request to appeal the decision was rejected in November.

Former security minister Sir John Hayes said: “This is an insult to every victim.

“This man should be kicked out of the country.”

The Ministry of the Interior announced: “We filed a case to deport this person and lost in the courts.”
