A HORRIFYING picture of the balcony where a toddler fell to his death shows the hidden danger that caused him to fall.

James Carter and Anastacia Duboshina watched in horror as their toddler fell through a window that was missing glass.
The heartbroken parents have since filed a wrongful-death lawsuit against the Hyatt, accusing them of misconduct and negligence.
James, of San Diego, tearfully told the San Diego Union-Tribune, “I relive it every day.
“I stood there and watched him fall nine stories. It’s horrible.”
Little Nico was playing on a glass-paneled ninth-floor balcony moments before he died in 2021.
One of the panels was missing, without any cones, warnings, warning tape or signs, the lawsuit said.
The glass sliding door, which led to a very narrow balcony, apparently had an opening large enough for a toddler to accidentally walk through.
His devastated mother said: “Our boy’s death was so senseless and so completely preventable.
“We want justice. We chose Hyatt primarily because of its safety. We want them to take responsibility for what they did.
“Because no parent should have to go through what we’re going through. It’s so painful.”
James added: “We’ll never get over it. We still have his bedroom. We couldn’t get rid of it. We just couldn’t do it.”
The devastated parents’ lawsuit claims that “Because the panels were clean, the Carters could not have visibly discerned that one of the panels was missing.
– The danger was invisible.
Nico died just weeks before his second birthday at the Hyatt Ziva Puerto Vallarta hotel.
His mother was packing snacks for the family to take with them to the beach when she heard her husband’s horrifying screams, according to the case.
“Anastasia was walking out the hotel room door to let James and Nico know she was ready when she suddenly heard her husband’s horrible scream.”
“Nico stepped onto the balcony between an open sliding door and a section of railing that was missing a panel and fell more than 30 feet down onto the concrete deck.”
Anastasia told the San Diego Union-Tribune, “In a split second, my life went from everything to nothing.
“My world fell to pieces in one second.”
She said she hoped the hotel industry would take Nica’s case seriously as a warning for hotel safety measures.
“Hopefully, maybe by filing this lawsuit, if we prevent one death of another child, mission accomplished. Our child did not die in vain.”
A Hyatt spokesperson said: “While it is our policy not to comment on potential or pending disputes, Hyatt has been working closely with Playa Hotels & Resorts, the operator of the Hyatt Ziva Puerto Vallarta, in an effort to ensure a full and transparent investigation since this tragedy occurred in October 2021
“Guest safety remains our highest priority, and our hearts go out to the family following this unimaginable loss.”
