Heidi Yates, the ACT Victims of Crime Commissioner, stated she “carefully considered [her] responsibilities” to Brittany Higgins when she made the decision to accompany Ms. Higgins to court each day throughout Bruce Lehrmann’s trial.

The allegations made after the trial that it was wrong for her to be the “public face of support” had “concerned her greatly,” Ms. Yates stated before the Board of Inquiry on Thursday, June 1.

She said, “I emphasise that, in my opinion, those worries maybe reflect a misperception of my function in the legal system.

Ms. Yates testified to the inquiry that she is required to support a complainant in her capacity as a VCC while also recognising the accused’s entitlement to a fair trial and the presumption of innocence under the Human Rights Act.

Ms. Yates “absolutely acknowledged that possibility” when asked by inquiry chair Walter Sofronoff KC if there are instances in which the VCC’s services “run the risk of avoidably asserting that your client is, in fact, a victim” as opposed to a complainant who has met the requirements of the law and is eligible for support services.

Ms Yates said, “I don’t,” when Mr Sofronoff questioned her about if she felt she had “crossed [a] line” by “standing by Ms Higgins in a case of public notoriety.”

“I think I gave careful thought to my obligations to Ms. Higgins under the [Victims of Crime] Act, and in doing so, I was aware of my obligations under the Human Rights Act,” the author asserts.

Ms. Yates also informed the inquiry that she had requested permission from the police and DPP Shane Drumgold on a number of occasions, including initially inquiring verbally and via email with Detective Inspector Marcus Boorman about whether it was appropriate for her to be named as Ms. Higgins’ point of contact with the police. Mr. Drumgold, with whom she also spoke about her choice to enter the courtroom with Ms. Higgins, expressed no worries about it.

Erin Longbottom KC, the attorney aiding the investigation, questioned Ms. Yates about whether she would opt to publicly enter court with Ms. Higgins again if she had the benefit of hindsight.

“It’s difficult to say whether I would have chosen differently if I could go back in time and think about what happened. I’m certain that, given the information at my disposal at the time, I made a reasonable choice in weighing all of the factors I was supposed to consider,” she retorted.

Are there any lessons to be drawn from this instance regarding the possibility that my intentions to pass her unnoticed might have been unclear? Yes, there are, and I would surely take that into account if a victim asked me to be with them in the future.
