Jamie Foxx Accused of Sexual Assault in NYC Restaurant in Lawsuit

Jamie Foxx has been accused of sexually assaulting a woman at a New York restaurant, according to court records.

The woman’s lawsuit, filed in New York Supreme Court on Wednesday and obtained by PEOPLE, alleges the incident occurred in August 2015 at Catch NYC.

The alleged victim, referred to as Jane Doe, claims she walked into the establishment where she saw Catch Hospitality Group co-founder Mark Birnbaum sitting “one table away having a drink” with Foxx, 55, whose real name is Eric Marlon Bishop.

Doe claimed that around 1:00 a.m., she and a friend approached Foxx’s desk to ask for a picture with the Oscar winner. She claimed he replied: “Sure honey, anything for you” and proceeded to take “a few photos”.

In the complaint, the woman alleged that Foxx “acted drunk.”

She claims Burial the actor told her, “Wow, you have that supermodel body,” “You smell so good,” and “You look like Nickie.” When she asked “Who’s Nickie?”, Foxx replied, “Gabrielle Union.” She stated that he then grabbed her arm and pulled her to the back of the roof.

The court filing states that once she and Foxx were in a secluded area, he “placed both of his hands on her waist, moved them under her ‘short top,’ and began rubbing her breasts.”

She said she tried to move away from him and noticed a security guard “some distance away,” who saw what was happening but moved on. Doe alleged that Foxx reached into her pants and put his fingers on and in her vagina and anus.

The woman added that sometime around that time, her friend went outside and when she saw another woman, Foxx stopped and approached the security guard.

Doe said his actions left her “hurt [and] he was declared sick, painful, lame and disabled; [and] underwent treatment and counseling.”

Doe added that she “was unable to continue with her usual and regular activities; was caused to undergo great conscious pain and suffering, continues to suffer and will be permanently affected by the injuries and emotional distress she suffered as a result of the sexual assault, abuse, assault and battery.”

The documents refer to Foxx as a “well-known celebrity [who] committed heinous acts.” Doe said she “suffered and continues to suffer physical and emotional injury, anguish, distress, embarrassment and economic harm.”

She is seeking damages for pain and suffering, economic loss as well as punitive damages in an amount that exceeds the jurisdiction of all lower courts.

PEOPLE reached out to Jamie Foxx’s reps for comment, but they did not immediately respond.

Wednesday is the last day to file lawsuits under New York’s Adult Survivors Act.

According to MSNBC, it allows sexual assault victims who were 18 or older at the time of the abuse a one-year lookback period to file a lawsuit against the abuser and, if applicable, the institution that protected them, regardless of how long ago the crime occurred.

Several other major allegations were made against men within the industry before Wednesday’s deadline.

On November 16, Casandra “Cassie” Ventura filed a lawsuit in New York against ex-boyfriend and music mogul Sean “Diddy” Combs, accusing him of rape, sex trafficking and domestic violence over a 10-year period.

A day later, both sides agreed to an “amicable” settlement.

On Wednesday, just days later, Harve Pierre, the former president of Combs’ Bad Boy Records, was also accused of grooming, sexual harassment and sexual assault by a former assistant. The filing alleges that Pierre sexually assaulted the plaintiff on “multiple occasions in New York and other locations around the country” during 2016 and 2017.
