Jamie Foxx Denies Sexual Assault Incident at N.Y.C. Restaurant, Says It ‘Never Happened’: Rep

Jamie Foxx denies allegations against him in a new lawsuit alleging he sexually assaulted a woman at a New York restaurant in 2015.

On Thursday, a spokesperson for the actor, 55, told PEOPLE, “The alleged incident never occurred.”

“In 2020, that person filed an almost identical lawsuit in Brooklyn. That case was dismissed shortly thereafter,” they continued. “The lawsuits are no more viable today than they were then. We are confident they will be dismissed again.”

“And when they do, Mr. Foxx intends to file a malicious prosecution lawsuit against this individual and his attorneys for refiling this frivolous lawsuit,” the spokesperson added.

The lawsuit against Foxx was filed in New York Supreme Court on Wednesday. Documents obtained by PEOPLE show that the alleged victim, identified only as Jane Doe, said the incident in question took place in August 2015 at Catch NYC.

The alleged victim claimed that when she and a friend entered the establishment’s rooftop bar and lounge, they saw Catch Hospitality Group co-founder Mark Birnbaum sitting “one table away having a drink” with Foxx, whose real name is Eric Marlon Bishop.

The alleged victim claimed that around 1:00 a.m., she and a friend approached Foxx’s desk to ask for a picture with the Oscar winner. She claimed he replied: “Sure honey, anything for you” and proceeded to take “a few photos”.

Foxx, who the woman said in the complaint “seemed drunk,” allegedly told Jane Doe, “Wow, you have that supermodel body,” “You smell so good” and “You look like Nickie.” (According to court documents, when she asked “Who’s Nickie?” Foxx replied, “Gabrielle Union,” and then allegedly grabbed her arm and pulled her to the back of the roof.

The court filing states that after taking Jane Doe to a secluded area, Foxx “placed both of his hands on her waist, moved them under her ‘short top,’ and began rubbing her breasts.”

The alleged victim said she “tried to get away from Foxx” and noticed the security guard, who reportedly saw what was happening but walked away.

Doe alleged that Foxx reached into her pants and put his fingers on and in her vagina and anus. After her friend got back at her, Foxx allegedly stopped touching the alleged victim and moved away to stand next to the security guard.

The lawsuit against Foxx was filed on the last day to file cases under New York’s Adult Survivors Act, which for the past year has allowed victims of sexual assault who were 18 or older at the time of the abuse a one-year look-back period to file a lawsuit against the abuser and, if applicable, the institution that harbored them, regardless of how long ago the crime occurred, according to MSNBC.

In a court filing, Jane Doe alleged that she “suffered and continues to suffer physical and emotional injury, anguish, distress, embarrassment and economic harm.”

She is seeking damages for pain and suffering, economic loss as well as punitive damages in an amount that exceeds the jurisdiction of all lower courts.
