According to a BBC report on Monday, the British government could be sued over the question of whether leaving the European Union will inevitably result in leaving the single market.

To remove the decision from government scrutiny, pro-EU think tank British Influence will notify Brexit Secretary David Davis who will launch a judicial review. This will allow parliament to vote on the country’s membership in the European Economic Area (EEA).

The EEA, which allows for the duty-free movement of goods, services, capital and labor, includes all EU member states. The government claims that if it leaves the EU, the EEA will follow suit, but British Influence counters that it must first activate Article 127 of the EEA agreement, which requires parliamentary consent.

According to Jonathan Lis, deputy director of British Influence, “there is a strong possibility that the UK will act illegally by taking us out of the EEA with Brexit…so we will be seeking a judicial review.”

“Since Article 127 sets out an express procedure for withdrawal, it automatically prohibits other implicit methods of withdrawal, such as ceasing to be a member of the EU,” said lawyer Jolyon Maugham.

Dominic Raab, a Brexit campaigner and Conservative MP, accused the lawyers of “inventing new legal obstacles to try to thwart the will of the people.” The public has spoken; we must respect the result and move forward instead of trying to erect new obstacles that threaten the democratic process.

The government is already embroiled in a second legal battle over Brexit after the High Court ruled that the government must seek parliamentary assent before invoking Article 50 of the Lisbon Treaty, which gives notice of a decision to leave the EU. Next Monday, the government’s appeal will be heard by the British Supreme Court.
